Is this rape?

me and my friend went out to this guys house party. She got completely wasted, i was pretty drunk but not so bad as her.
Anyway, this guys older brother started hitting on her and trying to snog her, and she was like 'No, i dont like you'. i remember that.
We both passed out, and when i woke up next morning it was obvious theyd slept together.
My mate has no memory of sleeping with him, she was way too drunk to know what she was doing, but i remember her telling him 'no'.
so, would that be classified as rape?

i didnt forget everything else, its just i get sleepy from alcohol so i passed out before she did. i do remember the night though.

Ask the guy, and speak to the girl. If the guy says they did, and the girl says she said no but can't remember, then yes, I guess it is rape. Sorry to say.

won't hold up in court quite honestly.
you stated "I remember that", yet you forgot everything else as did she... you remember one small part. you do not know if she changed her mind. neither does she for that matter.
So legally no, it is not rape unless there is some form proof, it was recorded, pictures showing her struggle, other witnesses, a hospital exam showing forced entry etc...
But as of now w/o any proof, (in the eye of the law) there was no rape.

Yeah sounds like it. It is also a good reason not to get so drunk you become unaware of what is going on around you.

ok this is not a joking matter. yes she was raped. if she did not consent then its rape, if she didnt say yes or no then its still rape (again there is no consent). its only not rape when she actually says yes. if shes doesnt remember giving consent its still rape but will be horrible to prove when it goes to court. Please please report this to police immediately for further advice.

Just because she was .laying next too..does not mean anything..did your friend get a rape test?..as you said both ..not aware of what was happening around you...Hopefuly ..you have learned something..never... ever.lose control over your surroundings and promise that yall will never let it happen again..next time ..ya may be wondering ..who raped and killed her ..OR YOU....

Yes. Legally, if a woman doesn't give consent to the act, even if it's because she's too drunk to give consent then it is considered rape as it was non-consensual.

Yes, it is almost a text book example of a typical rape. There is more than enough evidence to at least give prosecutors a reasonable hope of conviction - not many rape cases have little more than collaborating witness statements - I particularly liked "Uh huh, go on I'm listening"'s opinion that a rape cant be proved without someone filming it or taking pictures!!!! Who the hell films a rape????

yes to common people, no in the eyes of the Law
unless the person can recall the events, and can prove beyond a reasonable that it was rape (sorry) then there is no case to answer

She might have said no & then changed her mind later. I really cant say. Im not sure. If you were so concerned you should not have left her knowing that she could not make good decisions at the time.

No its not rape once she purposely got herself drunk around another drunk didn't control herself and he didn't control himself why is he the rapist. They both were drunk why is he responsible for his actions and not her
