Is this the Laundry's or our fault?
Find answers to your legal question.

Is this the Laundry's or our fault?

Today, I went to the Laundry to wash a blanket. When it came out of the dryer, the blanket had some serious burns on various places. This was not the only thing. There were stains on some of the places along with the burns. The owner of the store said I dried it too much and that is why it happened. However, some parts of the blankets were not even dried. Okay, maybe we'll take the blame for the burns, but how do you explain the stains? Can we sue this Laundry?

For the burns and stains? How hard will it be to sue?

You shouldn't be responsible for the burn marks on your blanket. That sounds like faulty machinery to me. Stains may appears (that were already there- but that do not present themselves UNTIL the material is cleaned.) Regarding the burn marks, if you can prove that their dryer burned the blanket, you are entitled to compensation based on the age of the blanket.

If the blanket is 5 years old or older - expect 10% value of the original price as compensation. If the blanket is less than 1 year old, you are entitled to 80% or thereabouts - but you might be required to prove the machine caused it.

Some blankets are made of a combination of materials that must be dried on a low heat, or suffer burns.

Also, some stains don't show up until the item is dried.

I'd say you have no cause of action. The time and money you would spend to get your blanket replaced would not be worth it.

Most places have "Use at your own risk" notices placed. Public laundromats have almost no control over what is placed in the equipment. There are notices not to place plastic items and such in dryers, but people will put polyester blankets, pillows and other items in them. They may melt or burn.

Did you check the dryer to see if there was anything in it, or stuck to it before putting your blanket in?

Did the blanket have a label as to washing and drying instructions? Did you follow the instructions?

What would you sue them for? The most they may be liable for is the cost of replacing that blanket.

Talk to the owner, if they will not replace it, or offer part of the replacement cost, yes you could sue in small claims, but your case will be very weak. You have a responsibility also.

You take the risk when using a public laundry. Suing for a blanket would cost more than getting a new blanket.

dawg
most laundry's have signs(NOT RESPONSIBLE)
i would check.but either way. you are the one responsible.
would it be worth the money to take them to court? and even waste the courts time?

Most dryers in public laundry house do not have temperature settings so are just one heat setting. You do not say what is content of the blanket so perhaps it should have been hung out to dry. Maybe the dryer was too small for the size of the blanket. So guess there are too many variables that could have caused the burns and stains to get a clear decision if it was your fault, the dryer's fault, or the manufacturer's fault for not giving cleaning instructions. At any rate, guess you now have a blanket that can be cut up for rags or used as padding under your bed sheets or as bedding for your pet.
