Ninety-five percent of all case plead out. Often offers get worse as the case goes on. An attorney has a duty to explain what they believe. When I was a prosecutor, a friend of mine had a case that got really ugly. The Defendant, facing life, was offered 5 years, with parole at 2.5 years. He turned it down. He is doing 30 to life. In 15 more years, he will get a shot at parole. He has done 12 years. His attorney begged him to take the deal. Sometimes, the deal is to good to pass up. The lawyer did nothing improper. The decision is yours. |

Usually a lawyer will have you plea not guilty, and let the state attorney make his or her own case. But, you can change your plea to guilty or no-contest. It really depends how much money to have to spend on the case and what you did. |

A PAID lawyer (one you are paying out of pocket for) or a Public defender? That sounds like something a PD would say since they have thousands of people to defend for free and they just want to get you out of the way.
If your paid lawyer is telling you that, you need to get your money back and find a new lawyer. |

A lawyer's job is to get you the best deal possible. If you know you are going to be convicted, you will usually get a better deal or sentence if you plead guilty and that will mitigate your sentence. Also many times I will be offered a deal for my client to get a better sentence if they plead guilty to a lesser charge, for instance, manslaughter vs. murder. Hard to tell with out a lot more facts, but this really is a question you and your family should ask your lawyer about. He or she will not be offended. It is a questions every one of us answers every day for our clients. |
