Is what my boss doing illegal?
Find answers to your legal question.

Is what my boss doing illegal?

We are required to be at work at 6:45 am. Often, the supervisor, the one who has the keys, is late. This has been going on for well over a year now. If the supervisor is late, no one can clock in. When she is late, I have to sit in my car for up to 20 minutes on my time waiting for her. There is no way to clock in when I got there. Only when the supervisor gets there. Also, now during our lunch breaks, we are being asked to help the front desk if it gets busy, while we are off the clock. The issue is that this is Colorado and the law states we need uninterrupted lunch breaks. I brought this up in a staff meeting and the boss and supervisor got very defensive and all the other employees laughed it off. This is a minimum wage job where I feel I get little enough appreciation for what I do verbally and monetarily. I like my boss and don't want to get her in trouble with the law. I hate my supervisor. But more importantly, I just don't like being taken advantage of and feel like that is what is happening. What should I do? My boss and supervisor thinks its a joke. And while 5 minutes here and there makes no difference as far as wages go, if you add up 5 minutes everyday I work, it adds up to quite a lot. Even if I clocked in to help during my break it goes against the workers law in Colorado as we are required to have a break time with no job responsibilities. Advice?

I don't really want to get this government involved. I like my boss and she is the one who would be getting in trouble. I would love to find a new job, but given the fantastic economy, well I just can't pick between all the job offers coming my way. So I'll stay with my min wage paying job (forgive my sarcasm. I'm kind of upset).

Oh wait, hold on.

I would say to your boss and whomever else that laughs...

That is your money .....they are messy with you, laugh if you want, but that's money. Be very Straight up, and don't sugar coat it.

Tell your boss and then go up from there, also say i would like to be back paid, im not there for free. My time is money.

Below is A link to the "Better Business Bureau". Hit the contact us button at the top to get in touch with your local BBB and report this. It is completely anonymous and will put an end to this garbage.

It sure is illegal!

Contact your state's bureau of labor. They'll keep your identity confidential.

if you are required to be at work at 6.45am and you are there, when you're finally let into the office, write that you arrived at 6.45am. Or you could just arrive 20 minutes later when the supervisor actually arrives. What do the other employees do?
Do you have a workers union you can talk to? They always help.
As for the lunch break, when its your luch break, then just go and have your lunch, even if you're asked to help somewhere else.
They can't sack you for any of this, because that would be unfair dismissal and just let them know that you kniow your rights.
