I just heard this story about this boy finding out someone made a fake Myspace page of him, saying that he had attempted to rape several girls and was a pothead. He went to the police, and the senator of his state, but they told him it wasn't against the law, so they couldn't do anything about it!!! But it is against the law, isn't it? Wouldn't it be libel, and fraud? Maybe even Identity theft? Additional Details The story comes from the Dr. Phil show. The seventeen year old named Andrew, from Tennessee. He doesn't know who made the page, by the way. So he can't sue.

It's libel and defamation, but those are civil offenses, not criminal offenses. He has standing to sue, but it's not something they can be arrested for. |

If the guy who made the web page was saying that HE (guy who made web) was saying that he was him(kid who had a fake page made of him) then yes, it IS against the law. Pretty stupid, I think!(senator saying otherwise)!!!! |

you know what, i think it is against the law, but i also think it depends on the state you live in. i think where i live they have outlawed "cyber bullying" and i definetely think this falls under that. its not fair and its wrong. i hope this helps. take care |

Several things: first, it would depend on the state where the person posted the information.
Second, where did you hear about this?
Third, who was the boy? What state does he live in?
Is there any substantial evidence that this is true, or just a rumor?

it's not against the law because they didn't really "steal" his identity. im mean yeah, sure it was a sick joke, and that person should go up to the person who did that and send them straight. its cruel to play pranks like that, but i don't think it's illegal. |

Not really because he is still being himself on the myspace page. He is just saying lies about himself that aren't true. You can't get in trouble for these lies because they aren't anything anyone can prove to be true. Its like saying you exploded your principal's car, which would be a crime, but his car is in mint condition and its obviously not true.
But I can see where something like that could be looked at as something serious. I wonder what the cops do if a guy starts telling people he's a murderer when he really isn't.. |

No it is not against the law...a girl at my work made a fake myspace page that was supposed to be from this boy making fun of me and my friends...and he got coached...it was stupid...
Libel only counts when you have a position in government, fraud is completely different, and he didn't still any identity |
