In court, how to lawyers know all the right questions to ask, the right things to say..?
Just curious.
They seem confident and know what they're talking about, how do they do it?

They prepare - a lot. A good litigator knows the case backwards and forwards and not only knows what to ask but also what the answer will be. |

well, you have to have a good feel for people. the ones on tv are more confident than alot of real life ones. also, there are books they give lawyers questions to ask about different cases. |

They study the laws and cracks in the law. Beside on that, they know what questions to ask to get the answer they want. If you ask a math teacher questions about math, they will answer confidently because they know all the formals and everything. Ask a airline pilot about aviation and they will talk confidently because they know what they’re talking about. Same with a lawyer, they really study the laws and know what their talking about. (Just my option: P) |

Heh, why do you think they call it "practicing" law?
One of the best ways to learn anything is to watch people who are good at it. I used to go watch the best lawyers in my office when they tried their cases. I also worked doing appeals for a long time, which involves reading a lot of transcripts of trials--you learn what are good questions to ask, and which ones will get you (or your case) in trouble.
We also study the rules of evidence in law school.
And we prepare, prepare, prepare for trial. Most of the lawyers you see are not just "winging it"--they have carefully planned what questions they are going to ask, and tried to anticipate the unexpected--you never know what a witness might say when they get on the stand. Even when I have prepared my witnesses carefully and know what I expect them to say, I am often surprised. The trick is not to show it, and roll with whatever comes out. |
