This ticket is 400$, here is what happen, i went with a buddy who said he needed help carrying alcohol, so i went and got it out of the back of a car and put it into bags with him, we both had had nothing to drink, i planned on not even drinking, none of the alcohol was mine, i was just helping carry it. The cop zoomed up in an undercover car, i set the bag down and started walking, as did my other friends, the cop said stop and all three of us 19 year olds turned around, is this age discrimination, how can i get out of this, i was just carrying the dam bag!

How is it age discrimination? You are a minor in possession. You should have a lawyer. If you can't afford one, then they have to supply one. If your record is clean, you can probably get away with an alcohol rehab program and maybe a little community service and if you keep your nose clean for a year, you might get your record cleared.
By the way, not the smartest move to publicly admit your guilt. |

To be guilty of the crime charged, you only have to have been in possession of alcohol. The cops saw you carrying it, so they will likely argue that you're guilty. However, consider the following analogy as a defense:
Let's say you worked at a grocery store and took people's groceries to their cars, and one day, you're helping someone transport beer and wine to their car. You lift the beer out of the grocery cart and put it in the trunk... Could you be charged with minor possession? If you're telling the truth, I frankly don't see any meaningful difference between your situation and the one in my hypothetical. Sure, in your case, you were helping a friend carry alcohol, and you were not at work, but I don't really see why that matters. "Possession" must mean something more than merely helping someone carry something. In my view, one does not exercise "possession" over something unless he plans to, or has, made it his. and you weren't planning on making this yours, according to your story.
One damning fact is that your friend was 19 (not 21). Even if you weren't in possession under my legal theory, you may have been aiding and abetting minor possession, or something like that, since you knew he was under 21.
Finally, this is clearly not age discrimination. You'll get laughed at if you say that. |

argue your case. it's illegal to sell minors alcohol, i never heard anything about it being illegal for minors to be in possession of it, they just can't consume it, if he tested your BAC then you should be fine, if he didn't test you, he didn't do his job, slam him for it. |

Same thing happened to me man. Except i was 17. Anyway, i dunno the specific laws where you are, but i also got a $400 fine. I went to court, and they gave me community service instead of the fine. Just stay cool, be polite and ask for community service. You will probably get a lot of community service hours, but its better than a fine and a big thing on your record. Oh yeah and they cleared my record too. But then again i was under 18 so i dunno if the same thing will happen with you. |

The charge will stick with you unless you challenge it but you could possibly do some community service instead of paying. I would not challenge it as they will come down harder if you do so.
Also it depends on what state and area of that state you are in. |
