Landlord letter......................

i owe rent arrears due to losing job (current financial market) trying to get jobs, owe rent arrears, got housing benenfit awarded and paid alot into my landlords account recently to try and clear arrears

i sent a letter to his new letting agency and told them i had paid and asked to pass the letter onto landlord and confirm to me that they'd received it and they are ignoring me which im disgusted about.

they havent confirmed my payment or letter they should have the decency to confirm it.

so do i send a letter direct to the landlord? i used to deal with him directly (but he's pursuing court proceedings for eviction) i am making an effort to clear the arrears.

i was wondering if it was worth sending a letter to my landlord saying i have paid this £...into your account, and ask if he would consider cancelling the court eviction proceedings?

i really dont want to go to court and i plan to move out of the property anyway but still pay back arrears.

he has grounds on section 8 and ground 10 of section 2 of housing act.

ive been told if the arrears are below 2 months then the section 8 will not work but on grounds 10 - any arrears it might.

i have been a good tenant of his for over 2 years

would it be worth a try to ask him to cancel proceedings and what would i say......

I would send it directly to the landlord or even give him a call regarding the matter if you have a contact number. If you have a hearing scheduled already for eviction be smart and attend it. Take any necessary documents that you have to prove that you are trying to clear up the arrears and payments you have made towards doing this and the reason why they happened to begin with. Also think about what you want to say as far as avoiding the situation in the future in case they ask you are ready with an answer. A lot of landlords will work with you if they know you are clearing up the past owed balance.


The Tank
Letting agencies can be notoriously inefficient so it's not necessarily your landlord's fault. You should from now onwards send copies of your letters directly to the landlord - and keep a copy yourself.

Presumably you have evidence that you have paid the money. A bank statement to show that the cheque had cleared should be adequate (use a copy not the original). That will be evidence of payment.

If you haven't kept copies of your letters, and theirs, so far and made sure that you have sent them Recorded Delivery, then please do so from now onwards.

If proceedings are being taken against you then it is for the landlord to show that you have not been paying the rent. It's not so easy to evict someone as you might think, especially if they have made lots of "reasonable efforts" to arrange payment.

The court will see your evidence of rent payment and read your correspondence to try and clear the arrears. They will balance this against the landlord (& agents) correspondence and behaviour before passing judgement.

Make sure that the landlord has done all of the things according to

I'm pretty sure that if you have arrears to due to unexpected unemployment you can ask the housing benefit to pay these arrears (or at least a part of) to the Landlord? You can also ask the letting agency to negotiate a repayment plan with Landlord so that you just pay slighlty more on your rent every month until the arrears are cleared. They would prob advise this as the best route to the landlord as it saves the costs involved in finding a new tennant and it would be much more likely that arrears are paid off if you are stil a tennant in the property. Keep copies of all letters that you send and that you receive and make a note of the date/time of any telephone calls and the person you spoke to - it will be handy to have this information if you have to appeal against an eviction order in court.

A letter is easy to ignore. Face to face is not. I suggest a meeting, as soon as possible.

maybe you should send it in a certified letter he has to sign for to prove he received it and always keep a receipt of any money you give him
