The prosecutor is the attorney representing the State. In a criminal case, the victim isn't the one bringing the action (even if the victim signed the original complaint), it is the State. Victims can't drop the charges on their own. The victim is, as you were told, a witness to a crime that was committed. Sometimes the victim is essential to a case, but sometimes a case can be proved without the victim's testimony. There may be other evidence sufficient to prove the charges even without the victim's testimony.

This happens in DV cases a lot. Victims are too scared to testify, or have decided they don't want to cooperate with the prosecutor. We do our best to investigate cases so they can be proved even without the victim.

Assault and battery is a criminal offense. If there has been a prosecuting attorney assigned by the city to prosecute you for this crime, he can decide to prosecute REGARDLESS of whether or not the accuser shows up at the trial.

You know that there's a prosecuting attorney, right? Do YOU have an attorney? That's the defense attorney. Which part of this is confusing you?
