Law can i kick my child out of home who is 16yrs old and also has ADHD a mental health problem?

he is rude aggresive vile and is spliting my family up what is the law on my behalf

I would have thought a more apropriate question would have been " how can I help my son".... if you kick him out, he will be alone and has no chance of anyone caring for him, hes your son, try pushing him in the right direction to get help.

does he have a room you can lock him in. If his disease if very bad then I wouldn't kick him out! If he is physically hurting someone I would call the police to come talk to him to calm him down!

yeah give up on him good idea my brother in law is like how you describe your son and his own mother gave up on him it is selfish you can kick him out there is no law stopping you just hopefully your morals will stop you but the best idea would be to contact social services they can help find him a house/flat/bedsit if you kick him out on the street you may have alot of guilt if something were to happen

The law depends on where you are.

I am in the UK and while I do not know the specifics of the law concerning "kicking out" a minor I would suggest that the first thing you are going to have to do is get help for you all. For the son with the problem and for you and the rest of the family.

I really feel for you- it is hard to be fair to your son, to your family AND to yourself so I totally understand where you are coming from.

But- he is your son and as such he deserves you to keep fighting FOR him.

And with ADHD your son NEEDS your help.

So- go out and get help before you go and admit defeat.

If he is/were still in school then you must first of all engage the school. Go to your doctor and ask for help. Ask for help from social services and get recognition for your plight. Let the professionals deal with the parts of your son's personality you cannot cope with anymore.

And remember- it is rarely so bad that there is no one who can help you.

Ask and talk about it- get help and help him to cope as well as get a break from it all. You can only be helped if you ask.

I know they're often slated but ask Social Services for help - thats what they are there for. They've actually been helping me immensly with a volunteer helper in my home as I'm a single mum who is on her own most of the time.

Don't kick him out - get him some more help and fast. He will benefit.

Depending on where you live, the age of forced emancipation is from 16 to 18, so just ask a local lawyer, it is a simple process, you might have to give the kid a little money till he is 18 (kind of like child support in a divorce), but that is a small price to pay for sanity at home.

Establishing rules and reading up on what you can do with a ADHD child.

I had one and once discipline was establish I didn't have a problem with him.

I agree, contact Social Services and ask about maybe sheltered accommodation or a hostel or something, but please don't kick him out. It sounds like you have put up with such a lot, his condition can't be easy to live with and I take my hat off to you, but how would you feel if something happened to him? Badger Social Services for help, it sounds like you all need it. Good luck.

If you live in the U.S…no, you can’t just kick him out. As parent you have the legal responsibility of providing for your child until they reach the age of majority (18) unless they’ve been emancipated prior to that. A parent cannot petition to have their child emancipated. The child must do it. And a judge will not approve it unless that child is able to *fully support* themselves, and has the maturity/ability to function as an adult (mental health problems is likely going to blow that one out of the water).

Here are some possible options:
1) boot camp
2) possibly sending him to a mental health facility (depending on the situation/the exact problems)
3) possibly requesting assistance through the court--maybe he could be declared an ‘unruly child’ or something to that effect which would allow the court to step in and attempt to provide some help (ie court ordered counseling, etc)

wow, I cannot even believe you have the nerve to ask this question. Now if he is violent, or breaking the law, then call the police. But if you are just sad at the lot life gave you, and mad that you have a difficult child, then sack up and take care of your responsibility!!

if he has a mental health problem does your son have a community mental health team or social worker? if yes you should speak to them about getting your son rehoused.
my parents did this but i was older in my mid 20s. i leaved in a residential home for mental ill people with 24 hour support for 2 years then got my own flat. getting kicked out by my parents was at the time traumatic but in the end has turned out to be the best thing. i get on great with my parents now visiting once a week for dinner plus I've got a part time job.
tell your sons social worker or who ever you don't want him there and if they do their job your son should get re-housed. its your house the law should if my experiance is anything to go by be on your side

I am in your situation and seriously if I could kick my son out at 15 I would! I tell him all the time to leave but he laughs at me. He goes to school when he feels like it. He's a complete pig! I won't even buy things for myself because I know he'll destroy it. I wish there was help for us mother's of these kids but even Children's Aid can't help. These kids rule us and it's horrible! Ontario (Toronto) has absolutely no help for parents like us. His father is just as much of a piece of shit because he walked away 15 yrs ago. and whenever I call for help he turns me away. So I'm left to raise this kid. I can't wait until he leaves!

WELL PUT PUD!! I am a daughter of a single mother with TWINS with ADHD at the age of 16 living in the uk. I am looking for the answer to the exact same question. Both myself and my mum have had help from the school, domestic violence help, police and social services after putting up with that kind of behavior for 5 years only now that my mum is getting physically abused and feeling suicidal that I have said this cannot go on any longer, citizans advice, special needs assessors at my brothers school are all saying they need to be kicked out. What can you do if you have done ALL that you can receiving help from all directions if the one in question wont help his/herself? My mums love is unconditional but they need to learn its not a joke. they will keep walking over you until they realize this. It was 7 years ago I was at there age. I now what it is to be a teenager and how you think you are right about everything but you still know what it is to respect someone (when you want to) and you know that it is wrong to hurt people and make them cry every day and destroy their home. The sooner they start fending for themselves the sooner they will realize the value of life and relationships. Yes it is a risk but there is no light at the end of the tunnel whilst they continue to take advantage of your unconditional love. Boys take a looong time to mature you could be putting up with this for years to come. To kick them out doesn't mean you are turning your back on them, it lets them know the extremity of the situation. You can still be there, in fact i'm sure the space will good As I know being in the current situation really does feel like it couldn't get much worse. Personally I think it is the right decision in our case, persuading my mum is another story. Plan. call social services tell them the extreme lengths we are being forced to take in hope they will find them some accomodation. I was advised today by the special needs assessor at their school that the social will not to anything unless she kicks them out first so Im going to tell them thats whats going to happen. Give my brothers the ultimatum. They even attempt their next exam of they are out. here goes. I want to help anyone in this situation as i know its not your fault. Society has corruped generations to come. I will be back with an update soon. hope this thread isnt too old xx

NO. Now, tell him U can get him some money if he goes to school and is nice. Then get him some money for that. Make a chart. Do not yell at him for dumb choices. That is hard for u to do but try not. Tell him u are trying to do better. RUN to the social security office, take yr paperwork where u took him to drs, his adhd diagnosis, and work hart to get a check then u can afford some more things to hold him over until he slowly grows and develops. I had one like that and he is my right hand now. He is grown , married and keeps a job. He was on SSI for about 4 years and decided he wanted to work. He was in the Army for a short while, but he is honest and a hard worker and clean. Keep yr boy. U might get old and need him.
