If i had an apartment and it was in my ex-girlfriends name and my name, but the gas bill was in my name and we agreed to pay half of each bill, legally if i took her to court for the ending balance would she have to pay half of it.

Unfortunately, your verbal agreement to share bills, was just that, a verbal agreement.
While it may not seem fair that you should have to pay her share, you are legally responsible since your name is on the bill.
If you went to small claims court a judge would probably say that you've learned a lesson the hard way, but that there is no evidence of your agreement to split bills. |

No, she wont have to fork up money to pay half. Had a situation just like yours, I got out of my apartment without paying closing bills such as gas/electric/phone but rent was non negotiable. She has to pay half of rent if its signed in both your names. Screwed my roommate outta money, the judge will suggest she pay but cant force her to do so. Try to get her to think you're really gonna take her to court, eventually the stress will make her give you the money. |

Probably not. It was in your name. When I was married I was pretty dumb and put alot of things in my name, to build credit, anyway I had to pay it all off. If you had a notorized agreement maybe. All she has to say if you show the lease is that you agreed to pay gas |

It would be best if you had some evidence that she paid half of the gas bill at some time during the co-tenancy, then you have a stronger case. Otherwise, you're going to have to argue that there was a verbal agreement. That may or may not fly. One point: you should go ahead and pay the gas bill off since it's in your name, then go after her for her portion. Don't just leave the bill hanging while you squabble about who pays what. It's your name on the bill and your credit that will be affected if its not paid. |
