Legal question about car accident?

I was in a car accident in December. I was on the interstate on a Sunday afternoon driving perfectly normal when a car came up and slammed into the back of me going like 90 (I was going about 65). They switched drivers and took off. I assume they were either under the influence or uninsured, or both. I was lucky that a truck driver saw the type of car and got the licence plate information so the police were able to track down the person that the car belongs to and get their address. They however told me that since they didnt catch the car and cant prove who was driving during the time of the accident, that they can't do anything legally about it? They said its up to my insurance company to get rembursed? Well they are still trying to do that and arent having any luck so they are likely to be out a lot of money. They gave me the value of my car, but that wasnt enough to pay off the loan so I was stuck paying for the rest of the car and am out the money for the valubles I lost. This just doesnt seem right to me? Someone totals my car and is 100% at fault, takes off, and nothing happens to them? Is there anything I can do? I was told the most I could do was small claims court to try and get rembursed for my loss. I dont want any medical or anything I just want the few thousand I am out for the value of my car. Do I need a lawyer? Any advice on what I can do would be greatly appreciated! Thanks!

You have a case against the owner of the car. Unless, the car was reported stolen.

yes,most lawyers will hear your case over the phone or online or in person (a free consultation they call it) and give you the run down.

laws vary by state, so that is the best (and really only) route if the police arent being too helpful
