It basically means that an employment contract can be "breached" without the person being fired or quitting. Just because the employment relationship is on going doesn't mean there isn't a breach of contract. Breach of contracts can be very, very technical violations of the contract provisions.
An example would be where the person continues to work there even after his pay is cut. If this violates the contract provisions, you have a breach. But you may not have the ability to recover if the individual continued to work there voluntarily, with disclosure that the terms had changed. In most at will states, technical breaches are 'cured' when the employer continues to work there. |
