So I went to LA fitness and haggled a deal where I would pay 3 years upfront at $20 a month and then after that I would pay $195 per year for my lifetime. After I signed, my friend told me about 24 hr fitness which has a better deal of $18 a month for the first 3 years and then 99 a year after that. I went to LA fitness and asked if they could beat that offer but they said 'no' so I canceled. they later called me on the phone and countered by offering a renewal rate of $60- the man said 'but you need to say yes now over the phone' he said that because I already went to them he could make the deal over the phone. I said yes and agreed to pick up my card a couple of days later. When I went to pick up my membership card, they told me that the manager decided it was too low and would have to charge me $75 instead of the $60.
I feel betrayed because that is not what I signed up for over the phone. They already charged my card with my consent under the contract of paying $60 for renewal before they told me about the change in price. Is it legal for them to change the contract on me like that? Is the phone contract binding enough or do I not have a case because I technically do not have any proof?

No, they have to give your money back. If they used your voice over the phone as the contract it should have included the entire conversation including the part where they said you would only pay $60. |
