First things first, is he going to court tomorrow for an indictment/arraignment? As a current law student, I HIGHLY recommend you hire a lawyer, and not request public defense. Entrapment is not easy to prove, and public defenders are usually swamped with tons of cases. I doubt that a public defender would be able to put the requisite amount of time towards finding out if an entrapment defense exists.

I think you should put a lot of your resources towards hiring a decent lawyer. If your son ever wants to attend college and get financial aid (which I assume he will need seeing as how you have to be indigent to get a public defender), he can't have a drug conviction on his record. A good portion of your son's future is riding on this. I wouldn't leave it up to a person who is doing it for free.

I personally dont think the punishment should be that bad. Nothing wrong with a bit of weed. But no offence, its Texas we're talking about. So dont be surprised if its a harsh punishment for something thats not that bad. Hope for the best though.

entrapment - IMHO - nope

entrapment is when you control all the variables - and snag the victim

1)Your son was probably in an area of the city/county known for sales.
2) He did not hang a sign around his neck saying - I GOT WEED - CHEEP
3) so the question had to be asked - hey - you got some for $20?
4) he could have answered - NOPE - I don't have any or sell - - - - -
but of course, he did and he did and he's busted

nothing hurts us as a parent than for a loved one to screw up
and mine tried to take something that wasn't his - and store security
nailed his heiney to the wall (and they were a former employer of mine!)

so the good part is he will get good counsel in the public defenders office

Under the Legal Limit

My experience is that public defenders are generally over worked and under paid. Therefore, they may not have the time to give his case all of the time that it needs. If I were in his shoes I'd hire an attorney that is willing to work on a payment plan. In his shoes with my life and future on the line I would hire an expert.
