Murder. Plain and simple. You are not authorized to detain or shot at illegal immigrants. It is only justifiable homicide if the illegal immigrant was threatening your life.

I would think it would be murder!If you're not a sworn officer of the law or military with orders to shoot to kill then you have no right to kill anyone! And could you define immigrant? Unless you are a Native American you too are an immigrant!

According to most states its murder; for the only way to justify homicide is in self defense. Unless the illegal immigrant threatened you with deadly force (and in California you didn't have an avenue to elude or evade) then you can use deadly force to defend yourself. Defense of boundaries, borders, property etc is not a permitted use of deadly force.

Anytime you kill another for any reason other than your self defense or the defense of another, to prevent the loss of your or thier life, you have committed a crime.

Now, whether it is Manslaughter or some other level of murder will be up to the prosecutor as to what he files.

Shooting an Illegal Immigrant to defend you country from invasoion is not enough.

In Texas, it is legal to shoot trespassers first, and ask questions later. That is why most immigrants go through the Arizona border.

I would say it's murder.

Because at the moment that you fired at this person, there is no way of being sure of whether he/she is an illegal immigrant, yet you did have an intention to harm or kill them.
I know many people have become sick of illegal immigration, but you also have to ask yourself if you would do the same thing at the Canadian border.
Taking the law into your own hands is usually frowned upon by law enforcement, especially when a crime of illegal immigration is being punished with death.

You DO NOT SHOOT HIM! If you catch him, just turn him over to the authorities or border patrol. It is not up to you to exact your kind of justice on him. I don't believe in this illegal immigration stuff either, but killing them is not the answer.

nah, thats murder. i'm all for ppl coming to the us the proper way, and protecting the borders and whatever, but shooting some random mexican dude for hopping a fence? you could have just punched him in the mouth and tossed him back to his side.

i think the most of the immigrants crossing indian border is for spreading terrorisom so, it is justifiable homicide in name of homeland security
