My Neighbour from the upper is spying on me?

From early in the morning until late night my neighbor from the upper floor is moving with me. I don't know how he is tracking my movements but he is always trying to position himself at the exact place on the upper floor in every room in my flat. I spoke with the police - they said they can't do anything about is. Do you have any idea how he is tracking my ovements? How can I protect myself?
