I received unemployment(in CA) after being terminated from my job, because of a customer complaint. It was directly related to that one complaint, but now that they are appealing, all of the little minute write ups(1 or 2)and warnings are now part of the big picture being brought up at the hearing. Almost everyone has the same kind of things in their file because this place documents EVERY little infraction (prob to cover their butt when they fire someone) What are my chances of being able to hold on to my unemployment ins? Any suggestions on what to bring up or defend? Do employers or employees have the advantage? As a single parent in this economy I need to keep my unemployment at all costs till I get rehired somewhere else. I was w/ that employer for over 4 yrs. Do I bring that up? If I was such a bad employee why would I remain there so long? What should I say and not say? I'm REALLY stressing out about this Thanks for any help

It comes down to the SPECIFIC reason that you were terminated. If you were terminated for the customer complaint, then that is the only information that is germane to the appeal. All the other stuff is filler and doesn't count. What you need to do is to look at the unemployment website and look at the section concerning acceptable and unacceptable reason for termination. There is a long list of acceptable reasons for termination. You need to see if your situation was a fair termination in the eyes of Unemployment. For instance, my neighbor had quit a job due to unsafe conditions on the job site. When he filed for unemployment, that company appealed the award due to the fact that he had voluntarily quit. On the unemployment web site it states that quitting for safety reasons is an acceptable reason to quit. He went to a hearing, explained his side and won. You need to see if you can find anything on the website that will cover what happened to you. If your company fired you for a breach of rules, I would think that unfortunately, you will not win. It truly does not matter any past history with the company, length of employment, or anything else. The issue is the one reason that you were terminated and that is all you can argue. Good luck. |

In NY state the employee has the advantage.
A lot depends on the nature of the complaint. Did you really do something that hurt your employer's business or reputation? What was the nature of the complaint?
Show that you were a reliable employee for 4 years. That you did not want to lose your job. Maybe that the customer's complaint was trivial, if it was. Was the complaint something you were able to dispute, or did you really do something wrong? Don't give any more information than you are asked to give. In NY it is a hearing and not a court case. |
