I think they are just trying to get with the courts and make things hard on me. She told me when she filed that she did not need support. And I trusted her but all of a sudden they came and and garnished my wages for current support and all this back support. they said I owe over 30K. If I dont pay they will take my license. Now to top it off her new man makes a good living and so does she. This year they bought a new house AND a new car, but I am struggling. Why should I have to pay that much when it just goes to there lifestyle? Can't I argue that it does not cost that much to raise a kid? Plus, now she has gone and puled some scam and made it so I am only allowed supervised visits with my son. AND they made it so the supervised visits are in there town which is 2 hours away. Plus I dont have no money for gas or nothing so how can I make it for visits anyhow? that was why i did not see my son since august. plus I have to pay for the person to supervise the visits and it costs me 50 bucks per 2 hour visit.
How can they scam me out of that much money? Additional Details I never did nothoing to make them say i can only have supervised. I just cant get the money up to call or visit. the econamy has been reel hard on me and i struggle to make my own ends meet. i cant get the money up to put minute on my phone to call so I have not got to see my son since august and before that was in feberary. I am a good dad i just fell on hard times and cant get the money up to see or talk to my son and my ex wont loan it to me

1) get a lawyer. legal advice may be costly but will save you more in the long run
2) child support is based on your income only. it is YOUR child and thus your responsibility to take care of your child. It is not something you can get out of via court order or private agreement.
3) If you are having financial hardship, you can go to the court and ask for "below table amounts" but you need to prove that.
You should get a lawyer and talk about these things, including visitation rights. |

My mom is a CEO of a company here is Los Angeles and she makes a lot of money.
My dad still pays her child support and he visits me on a regular basis.
He doesn't make as much money as my mom and he told me that he would go broke and be homeless if he had to just to be in my life.
He never asks money from my mom even though she has offered him money to help him during these times, he refuses to take it.
That is what a true father is all about. He does not make excuses. |

It doesnt matter what the ex makes, u were ordered by the courts to pay a certain amount and u will have to until the kids are 18. U can go back to the courts and ask for less, but its not for your ex or her hubby, but for the kids, so I doubt they will lower it. U must have done something for them to say u have to have supervised visits, so I would think about getting a 2nd job |

First off, it is not her man's responsibility to support YOUR kid, so despite his good pay it has nothing to do with you and your responsibilities.
You are making excuses for your selfish behavior.
Are you a little jealous that they have a good living and you don't?
You should've have put all this in perspective BEFORE you had a child.
Man up dude. Take care of your kid. Even if they were millionaires, you need to still pay your child support. |

Its not all of a sudden kiddo, you were party to the divorce and child support is part of that, maybe you didn't bother showing up, maybe you never read the papers, but you didn't wake up yesterday owing 30k.
The courts also didn't just decide you needed supervised visits, there was a reason, drugs, drink, alchohol? Or did you threaten to take him and run, or maybe even worse?
You might want to go to court to see about a reduction in child support, but they aren't going to be any more impressed than I was with your slanted story. |

I agree with the answerer who said you are making excuses. You are blaming the economy? Struggle to make your OWN needs met? Your kids needs come first, not yours. It doesn't cost much to raise a kid? OMG. I can't even fathom your thinking on that one.
This is YOUR kid! If the mother of your kid makes the money you say she does does not relieve you of your duty as a father. Are you seriously thinking that it does? What a shame.

My sons were with their mother until they were 15 and 14, until then, I worked two jobs to pay my child support and take care of myself and my kids. When they come to live with me, she whined just like youi are. You want to know where the child support goes? Drive by my house that has the mortgage paid on it where we live, drive with me when I take them to school, shopping, football games etc, when I stop and put gas int eh car, go with me to the doctors office when I pay the copays. Same with the Dentist. Lets go shopping for school clothes and school supplies. Come over while I am fixing one of their meals and see how much groceries cost.

All I have to say, if I had to drive 2 hours a day to see my kids and pay $50 bucks, I would get a 2nd job, my ex has the same excuses, my current husband came to see me and my kids after working all night and drove an hour each way, and never once complained, thats why he is my kids daddy to them now. Yes you should get an attorney, you will go to court and you will have to provide your income and she will have to provide her income only, not her spouses. Even if she said in the beginning she didnt want support, would you want to pay it for your kids? |

1. your ex's new husband's income has NOTHING to do with what you pay.
2. The court uses YOUR income and your ex's to determine the child support amount.
3. Stop whining about what they buy.... it has nothing to do with you.
4.If you don't want to pay and you haven[t seen your son in almost a year anyway, sign over your rights and let your son's step dad legally adopt him.. That way you won't owe a cent. |

"...it does not cost that much to raise a kid" - How much do you think it costs? The kid has to eat. He has to have a roof over his head. He needs a warm place to sleep. There is also transportation cost to go out and buy food and clothing, even if he is not with. There are the trips to soccer practice and the games. School supplies. Electricity. Light bulbs. Etc., etc., etc.
Be a MAN and help support the child you help create. Her new husband has no legal obligations to pay for anything for the child. If he wanted to, he could legally not have any of his money go to help raise the child. You are the father, and you have that obligation.
If you think you are being scammed, get a lawyer and go to court to have the payments reduced. But, it may backfire. My wife's ex tried that, and his payments INCREASED due to cost of living increase. I did adopt them soon after, so he is no longer obligated, but I am. And it is an obligation I enjoy doing.
*EDIT* - Most people fall on hard times every now and then. But, if your child was living with you, would you ignore him because you had fallen on hard times? No. Same with this situation. Your child should always be FIRST, MIDDLE and LAST thing on your mind. You come after that. |

They haven't 'scammed' you out of anything. Everything they did had to go through the courts. I find it strange you claim to have suddenly had your wages garnisheed. That doesn't happen until you fail to meet your obligations. Same with the supervision. The court has to have seen a reasonable claim that you needed to be supervised, not just her word.
I strongly suggest you get a lawyer who understands all this and can act in your behalf. I think there is a lot more to this story than you've told us. |

Most states have a calculation/formula that they use to compute how much you will pay in support. Her new boyfriend's income does not come into play at all unless you are in some weird state.
I would make an appointment with an attorney and have them calculate your support obligation from the statutes in your state. |
