Assuming you are from India, only a 'will' is probated.
If your father died intestate then you have to apply for a 'succession certficate' to a competant court.
Class I heirs of your father are:
1.Mother
2.Widowed wife

Yes - all estates must go through probate to allow any creditors the opportunity to recoup what is owed and to allow challenges to the division of assets (for example, hypothetically speaking of course, you can't be 100% sure your father didn't have a child out of wedlock who would be a rightful heir). |
