She can't abort an 8 month old fetus. The child is viable. The issue she will be facing is whether she wants to give the baby up for adoption or not once it's born. At the point that the baby is born, the child then becomes your child. The mother can sign away her parental rights. However, the child can not be adopted out without your signature doing the same.

Pretending it isn't: It's too late to have an abortion, so this is a moot point. She should have the baby and either give it to you or (if you don't want full custody) put it up for adoption. Period.

My PREVIOUS answer (before the new information) was:

"Who's right, me or the baby killer." Wow. I understand how personal this is to you, but this doesn't show even an attempt at respect for your girlfriend's--your child's mother's--situation, much less objectivity.

I'm glad you want to keep the baby, so here's a suggestion. Can you think of a way to make it worthwhile to your girlfriend to divert about a year of her life (assuming she gives you full custody--19 years if she doesn't) and put her body through the most dangerous thing a woman can do (until the 1900's, childbirth was the leading cause of death in women)? Ask her. Compromise. Work out a deal of some sort, if at all possible. Offer to take full custody after the baby's born (if you two ever decide to marry, then she can revisit motherhood). Offer to pay all medical bills. Etc.

Because if you can't, in the end, it's her decision.

You are not legally entitled to make that decision. A court is unlikely to rule in your favor because such a ruling would put an undue burden on her constitutional right to privacy. Therefore, as long as she is still in the pre-viability stage, it is her right to choose what she wants to do. While I agree that you both should discuss the matter to make an informed decision, the final say on the matter lies with her.

Additionally, you really should not be using yahoo answers as the means for making such important decisions.

I just noticed that you said she is 8 months pregnant, meaning she is past the point of viability. As such, in some jurisdictions, she would no longer have the right to an abortion.

Her choice, but if she is eight months pregnant she is not likely to find a doctor to do it. I am pretty sure that is illegal, except in cases where the mothers life is in danger.

I have always been pro life because there is life once a baby is conceived. I realize it is her body, but you produced a child in an act of love. Babies are not convenient, they are a life long commitment. They bring joy and can also bring hardship, but you have control over a human life that can develop into a viable productive human being that may become a wonderful scientist or even president of the U.S. I would not toss a life away because it isn't convenient, how cold it that? Do you want to stay with this woman the rest of your life? You must love her to want this baby and have a family with her. I would hope she would listen to her heart and not what mom has to say, after all, she is over 21. I hope you both make the right decision. Best to you both.

This is probably the heaviest question I've ever seen on Yahoo Answers. I honestly can't believe she's gonna base whether she wants her she wants her child to live or die based on thousands of people of who answer questions online for fun. Anyway it's too late to abort at 8 months, isn't it?

Did you know that you have a right to take her to court to stop her from having an abortion, and because she doesn't want the baby you can also try to get total custody of it when it is born?

hi im 19 and my gf is 20 she is 5 weeks pregnant iv spoken to my family and they could not say that much apart from my sister being like wow because shes got 2 kids anyways to the point i have gone out with many girls and 2 i thought i fell in love with but after meeting my latest one i no that i no i have now felt the warmth from wot love can give now i love this girl so much the only thing is she is going to be starting uni in september and she 5 weeks gone but i really want the baby shes 90% sure she dont but she still thinking on it after all 90% is not 100% i no shes got to put her future b4 this but i told her i would take care of the baby wile shes there i no i can take this challenge on my mates have always said i would b a good dad and i believe i can be 100% SURE ON THAT if anyone can just plz give me some advice plz help if u can
