If I sell a house to someone and I do not inform them that there might be a possible chinese drywall problem with the house, IE To be more specific I have a general knowledge that several OTHER houses in the same neighborhood as my property that I'm selling have been confirmed to have chinese drywall, however I have not had the inspection done on my property and the chinese drywall was never been confirmed on my property at the time of sale, even though AFTER the sale the house was confirmed positive as having chinese drywall by the new owner... No home inspection was conducted at the time of the property's sale (to save money, property was 2 years old brand new and never had been occupied at time of sale) and the sales contract was an AS IS short sale for the property.
The new owner is now trying to get the Home Developer to fix the property's chinese drywall problem since they are responsible for building the property this way. However they have told him that since the property was sold AS IS and that since he is not the original owner that they are not responsible for anything anymore. The home developer is usually fully responsible for the full cost of repairs in regards to this chinese drywall problem for these properties and even provides the owners another place to live and storage for their belongings while the property is being repaired, at least this is the case of many neighbors in the neighborhood. And once again they PAY EVERYTHING, however in this case they want to wipe their hands clean.
The new owner has told me he will not sue me but instead will sue the Home Developer in case they do not fix the property.
If he changes his mind does he have a case against me to sue me?
And if he decides to sue the developer instead and doesn't sue me as he says, can the developer basically TELL ON ME or get me in any trouble with the law because I didn't inform the new owner about the other houses that had chinese drywall in the neighborhood at the time of sale even though I DID NOT KNOW SPECIFICALLY THAT MY HOUSE HAD CHINESE DRYWALL and that in my property disclosure statement I put down that the house was fine and had no problems because I did not know that MY PROPERTY HAD CHINESE DRYWALL?
