Neighbor's small girl, can I be charged?

I live on a dead end road, and my neighbor's daughter had down-syndrome, and today I came to get in my car around 3pm,(the car that I usually park next to the house facing towards the deadend, that I usually keep locked) and when i got there the neighbor's girl (about 6 years old) was sitting in the driver's seat and god knows how long shes been in there. The car is a mustang and I have tinted windows, so its hard to see inside of it, and not to mention the heat inside...what if I didn't have to go to my car today and just stayed home and she remained in the car for longer and got hurt, is there anything that can be done to me? the car is mine, the car is on my property, and we are very close friends with the neighbor. I talked to her mother many times, about sitiuations similar to this, i just want to know what can happen to me?

You need to be careful about not getting yourself into situations like this. Make sure everything is locked and secure. You can also contact a local police station and describe the situation without saying it's you or giving out any personal information. |

Depending in what state your in is the first thing to know to get a legal definition. She is trespassing but it would be ruled out due to down syndrome. I feel it's the parents fault for not supervising her better. The parents should know where she is at all times and what she is doing at all times. |

You are not responsible for what happens to someone when they come onto your property uninvited...
her mother should keep a closer eye on her... go to the father instead... maybe he can talk to his wife...
but it is a little irresponsible to leave the car unlocked... what if someone steals it?
lock your car and have a talk with the parents... they are being irresponsible as well
stand up for her before she really gets hurt... then you will not forgive yourself....

I don't think much can happen to you. However I would contact CPS friends or not. This child could have died from the heat had you not gone and looked. Her parents should know where she is at all times.
From now on keep your car locked and if you see the child just roaming around call the police. Her parents lucked out this time. Next time they may not be so lucky, and having the cops show up could be the wake up call they need. |

It's a tossup between you having an "attractive nuisance" and your neighbor being "neglectful."
If this sort of situation has happened many times, you should start keeping a record of when you see the toddler running loose without a parent in tow -- and every time you do, call the neighbor on the phone and tell her where her kid is.

It is possible to get charged but if you stay close with your oneighbors and keep your car doors locked you should be good. Also, tell her parents so they know it's not your falt. |

there is no law that says you need to lock your property especially on your own lot. so no nothing to you can be done. however, if the girl did harm to your car, you could charge the parents for not watching their child. no worries |

probably nothing to you it'l be the parents will get charged for child neglect. knock on the neighbors door or call the cops do something don't just leave her in their at least get a ball or something she'd like to play with and put it on the lawn by the car maybe she'll come out to play with it. |

This was abosolutely not your fault. The only thing that could have been done is you locking your doors, but it's not like you knew that was going to happen. If her parents decided to take action, i'm pretty sure they would do what they can to press charges on you. But i see no reason why they would, considering you guys are friends, and you didn't mean for her to do that.

Nothing shouldn't she in your car but if she got hurt her parents could have sued you but you have a right to do something about it she should be in your car and how she get in it if you had it locked or she should of been at school |
