Neighbors dog came through our fence to go after my son!!?

My husband just spent 18 hours (he is not handy!) putting together a swingset for our 4 year old son. This was a project that I felt him unqualified for, but that is another issue.
After the set was assembled, my 4 year old was thrilled and wanted to run right out and swing and play. As soon as he was out there, the neighbors had guests show up and they had to put their dog outdoors. The dog immediately charged the fence where my son's swing is and then started to dig underneath. The fence is pretty sturdy (my husband had no part of it's assembly) so I had no fear of the dog taking the fence down. However, the dog got her entire head under the fence and was actually snapping at my feet as I tried to kick the fence boards back in place. My husband had to force the dog's head back in with a rock. The dog is aggressive (no kidding) and the family has to put her outdoors whenever they have guests. After the fence incident I went next door and used every single fiber of my being to hold myself back from telling the idiot mother to shoot her damn dog, and instead opted to ask her to bring her dog indoors as she was tearing our fence down in order to get at my son. She was snotty as hell (I may have been yelling at her, but it is my baby and I was pretty pissed) and agreed to bring her dog indoors. We just bought the house, and my son has not had much of a chance to go out and play in his yard. My fear is that this dog is visably agressive, and hell bent on tearing her way through a fence to munch on my kid. Do I call the dog officer NOW, or wait till after she does some real damage? The lady next door was very unconcerned with the fact that the dog went under a fence after a four year old and 2 adults and had to be forced back with a rock.

When I went over there, the lady was not moving very fast to go get her modern day Cujo, so I may have told her I was inclined to call the police if she did not find some spring in her step and MOVE. She was very concerned about me calling the cops and started to yell about that. I don't want to have my son be the guinea pig to test the fence's ability to withstand a hungry Pit Bull. Can a dog officer even do anything about this sort of issue?

Several things you can do - don't injure the dog - it is not the dog's fault that the owners are negligent with care and training. Start by approaching the neighbors and explain that they MUST fortify their fence so that there is NO way that their dog can get into your yard, and give them a time limit to get it done. You can suggest that large rocks or cinder blocks lining the base of the fence is a quick and easy fix against digging. In the interim, if there is anywhere the dog is attempting to enter your yard - liberally dump pepper in that area. The dog will have a sneezing fit and stay away from that spot. If they do not fix the fence to your liking then you will next need to contact animal control and explain the situation. There is no reason you should have to fear having your child out in your yard, and since the dog has already attempted to get into your yard and appears aggressive, that is enough for you to file a complaint with animal control. Be sure to tell them that the dog did that and that the neighbors don't seem to be showing concern or responsibility for a possibly aggressive dog. My last suggestion is most likely one you won't like, but you could find out from the neighbors if the dog is actually friendly and just being protective of its' property. If the dog is friendly then you could get to know the dog and makes friends and then he would stop being aggressive towards you. Food works wonders at befriending a dog. Good luck.

Sounds worrying! I'd be scared too. Firstly, videotape the dog's antics so that you have evidence, secondly, pressure hose the dog in the face whenever its snout appears under your fence (it'll give in!) and finally, if all else fails, call the police and present your evidence.

If the dog is licensed and vaccinated there's probably not much you can do until it bites someone, then it could be put down. But I can understand that's not an option, a four year old is no match for a pit bull. You could build a stronger fence, but that's expensive,,,you could get a bigger dog, but that really won't solve anything, you could wait till it's in your yard and shoot it, or you could get some bear urine or lion urine a put it on the fence,,,,don't know where you get it but it does exist and I understand it scares the hell out of dogs. or you could run out there with a hose or bat whenever the dog sticks his head under the fence smack the damn thing in the nose a few times, but this might make it more aggressive. I wouldn't recommend trying to kill it if it's not in your yard, that'll just get you in trouble. Call your local Animal Control, see what they say.

The videotaping is a great idea. (You probably don't want to use your son as bait.)

It's tricky; obviously you have to protect your son, and you have the right to the use and enjoyment of your yard. Having pissed-off neighbors isn't pleasant, either.

You might want to consult a lawyer, just so you can be sure every move you make is maximally effective. Sometimes a letter from a lawyer can put enough of a scare into them that they will not take a chance on getting sued for everything they own.

File a complaint with the police. By sticking it's head under your fence, it strayed onto your property and threatened your family. Responsible dog owners do not allow their dogs to run around their property unsupervised. Even if it's fenced in, there's a chance of it getting loose and either hurting somebody or getting hurt itself. In the meantime, keep a baseball bat and some pepper spray handy.
