Last year i put up a 15 foot frame pool in my back garden , the neighbor instantly accused me of flooding his garden , he says that the water now cant drain away in my garden because of the frame pool and it is flooding his garden , i have just brought a bigger pool a 16 foot frame pool , i have sealed all the bottoms of the fence so that no water can go underneath when it rains but still he comes round saying that the water still cant drain from my garden so is coming up in the soil in his garden, he is old and likes to moan at anything , i just want to no where i stand legally as he thinks its my fault his garden is flooding should i worry , or can i tell him to go get stuffed , politely of course.

You may be legally responsible if you are diverting water onto his property, or preventing water from running its natural course of drainage. From your description, I do not have a good understanding of how your property and garden, your neighbor's property and garden, and your pool are located in relation to one another. You say that you sealed all the bottoms of the fence so no water can go underneath... even if you have sealed the bottom of the fence, the water can still go into the soil and flow under the fence and possibly collect on your neighbor's property. |

If a permit is required for the pool and you don't have one, yes, you are legally responsible. If you have a permit or one isn't required, he'll have to prove your pool is responsible. |

Is rain water his concern? If so then tell him to get stuffed and don't be so polite about it. You have a right to do whatever you wish to your yard. Suggest to him that he relocate his garden. |
