I recently had a blood draw at Quest Diagnostics in the same building of my doctors office... upon going in the elevator and walking out afterwords, I collapsed and passed out unconscious.. face first into marble floor outside of elevator in lobby. Rushed up to my doctors office on 3rd floor where my B/P was 80/100 and my Dr. called/sent me to ER -- was vasal vagal syncope event... (not uncommon with blood draw) Quest claims no liablility once I leave facility... my lawyer referred me to medical malpractice lawyer as he couldn't help me... but I don't want to sue.. unless I REALLY have to.. and that takes time and I need my teeth fixed (have 1-1/2 weeks to spare) before dental work needs to be started. Teeth have been temporarily repaired and very fragile.
I've been told the building manager/their insurance should cover my teeth to be fixed... however:
1) I'm having a hard time trying to find contact information for the building manager; etc... did search on Yahoo and Google. I'm told the owner is the Kimball Group Inc. but number I have is not in service.
2) Whom might be the insurer to call directly?
3) Who can be held liable for the $4000+ in dental/medical bills I've just incurred?
Please help!
The facility is in Bridgeport, Connecticut at the Beechmont Medical Center on Main Street.

In re: to answers I'm getting:
1) I was told by several people at work, The Quest Supervisor whom told me it would fall on the building's insurance.
eg; If i fell on your property -- home, etc... regardless of how; etc... your home/apartment insurance would cover it.
2) I've contacted http://www.trantololaw.com/ for legal advice... however haven't heard anything yet.

Go talk to that malpractice lawyer to whom you were referred.
Part of a lawyer's job is to negotiate settlements without suing. 95%+ of injury cases like yours are settled without trial.
BTW, I don't know who told you the building manager would pay. I don't see how there is any way whatsoever the building manager is at fault for what happened.
BTW, I also don't see how Quest is responsible either, unless you had something like a pint or more drawn. The usual 10 or 15 milliliters of blood drawn for typical blood panels simply is not enough to cause a person to pass out.
Edit: Don't believe those several people at work, or the Quest supervisor, unless those persons are also lawyers. Contrary to popular belief, just because you are injured on my property does not make me, or my insurer, responsible for your injuries. I would be responsible only if I was negligent in some way. In your case, can you point to any negligent conduct on the part of the building manager??? |

uhh did you read the consent form that Quest usually has you sign before the draw? That will make all the difference in your case.... |

Not the building owners or insurance. They were not responsible for your passing out and were not negligent in any way. Also dont see any malpractice here. They drew blood and that is all. Seems like it was no ones fault but looks like you would be responsible for you own medical billls. |

You can probably find a lawyer who would take a case like that, which doesn't mean it wouldn't be a disgrace.
Sometimes sh*t happens. It isn't always somebody else's responsibility.
Stuff like this gives lawyers a bad name. And plaintiffs. |

Quest should pay as they drew your blood caused you to pass out.
You could have injured yourself even worse than you did.
talk to a malpractice lawyeer and I'm sure they can find precedents in your favor. It's not your fault for passing out and you should not suffer financial loss as a result.
Not sure about the building, unless the floor was wet, they probably can't be held responsible. |
