Pls HELP! SOMEONE CALLED CPS ON US!!!?

About two weeks ago my husband and I smoked a joint at our friends birthday party and someone found out and called CPS on us. Niether one of us drink beer or smoke and I really regret smoking that joint that night but it was our first time away from the baby since he was born (6 months ago). 4 days later CPS shows up and the lady was really nice and we were honest with her. She made us take the test and we failed for marijuana.

Then she called me back yesterday (two weeks later) saying that I'm a bad mom and I can't take care of my baby when I'm getting high all of the time. (WTF!)
I don't get high all the time and we were at a friend house miles from here and had a baby sitter. Thing is, we are awesome parents. My husband has a great job as a graphic artist and I have a degree in child development.
So what will happen next?
Are they going to take my baby away for smoking pot one time?

Next they will continue the investigation to see if the children are safe in your home. They cannot remove your children because you are a "bad parent" but they can if your children are not safe in the home. It is very unlikely that your children will removed for this referral. Since you had a babysitter and the child was not around there was no safety concern unless they find out more information during the investigation.

At my agency when we get cases like this we basically counsel the parents and explain the negative consequences of drug use and then close the case as long as there are no other concerns inthe hom. Just cooperate, it was good that you were honest and she shouldn't have said you were a bad mom. You never say that even if they really have problems.

I'm glad to see a few more thoughtful answers recently; this must be frightening as well as frustrating and I'm willing to bet neither summary sanctimonious judgments on your parenting skills nor ill-informed tirades about "the system" are much help to you. 1. My bias as an MD is that marijuana is an inappropriately demonized substance, and quite frankly I'd be far more worried if you were drinking around your kid than smoking this one-time joint while he was at home in the care of a babysitter. 2. CPS workers are overworked, underpaid, and every one I've met (sadly, I've had to meet a few in my line of work) puts up with the bureaucracy and social vitriol directed at them, so eloquently portrayed by some of these answers, because he or she really cares about kids. It sounds like you met a nasty one and I'm sorry about that- she had no right to say you're a bad parent (see #1). 3. No judge in her right mind would take your baby away because you smoked marijuana one time- because CPS is so overloaded, they really try to focus on truly abusive or dangerous situations. If they were worried enough to remove the child they would have done it already. I strongly suspect a lecture or at most a parenting class is the worst you can expect. Hang in there.

I doubt it, but don't take a chance...consult with a lawyer. You found a "busy body" that has little or no life, karma will take care of that person. Shut this person from your lives. CPS may monitor you, but keep you nose clean and jump through their hoops. This should blow over.

First of all, about half of these people who answered are brainwashed SHEEP. There is absolutely NO evidence anywhere that marijuana use is any more harmful (and it certainly isn't as potentially addictive) as alcohol.

I've heard this "you're a terrible parent" thing from girls who will go out to the bar and get trash wasted and then try to condemn other girls for what they do. Shame on all you sheep, you need to learn to think for yourselves.

Now, with that out of the way, the fact of that matter is that regardless of the facts about marijuana and alcohol, the powers that be HAVE deemed it to be illegal and as such there are consequences for breaking the law even if it is a silly law.

Like one person said, CPS and law enforcement are NOT your friends. Yes, they do a service by getting kids out of abusive or drug-addicted homes, but they are not there to be your friend.

Since you have already agreed to be drug tested once, you are now at the mercy of the system and may be required to take further drug tests. The good (and bad) news is that CPS is pretty overclogged with the influx of children who have been taken from REAL drug using parents (meth and crackheads) so they are not likely to sweep in and take your baby.

In the future, never "volunteer" ANY information to law enforcement. They will almost always use it against you. They can't do anything to you unless they have proof. Also, if you act scared, many of them will prey on you and be horribly mean to you (alot of those people are real control freaks) so the best thing to do is maintain an assertive, objective attitude along the lines of "I understand that I made a mistake, but I won't sit here and listen to you condemn me as a parent." Just because you made a mistake doesn't give them the right to be mean to you and you need to let them know that.

Many times if they are a true bully (like this woman - and a lot of these message boarders) they will back down if you stand your ground. Obviously, you don't want to be hostile, but you do want to be assertive.

well i certainly agree with you and i dont think that they should take away your child but that wont stop them at all. They might and it is a lesson learned but i would find out who called because id be upset and then someone was clearly spying on you or something along the sorts. I think that if they tried to you could take it to court and discuss it there. Was that the only time or did you do it before the test again

You should never admit drug use to CPS like that.

However, since you did, all you can do is offer to take future tests to show it was a one time thing. They won't take your child outright, the most they do is ask that they be sent to a relatives for a short while or something, if even that. Don't panic. I've had someone call on me before and I had them out of my hair in a week. It was over just yelling at my son who was throwing a fit in the store, so people call over stupid things.

but committing a crime, as small as it may be, will have consequences.... you know that, you are not a kid...
its ok to fool around once in a while... but be careful next time, or avoid it completely

Hey. I don't mean to sound like a prude or anything, but being a father myself and having a normal teenage past, let me tell you what I think.

I think that now that your all grown up, so to speak, you shouldn't really be going to parties that involve marijuana. Drinking is a whole different ballgame. It isn't that the Marijuana is worse than the drinking (with an alcoholic father, I'd prefer the Marijuana), but the fact that now you are, wether you like it or not, a role model. Unless you really mess this up, your child WILL look up to you for a long long time and your actions will mold them in to the person they will become for the rest of their lives.

A child has a little world that it creates for his or herself. Do you want this child life to include Marijuana? Even if you don't use it that often or if it's only your friends, the child will still take in all this as "things that are acceptable.". After all, if mom and dad are friends with drug users, why shouldn't I become a drug user myself?

Now that you're a parent like myself, I'd say it's high time (excuse the pun) that WE lay our childhood to rest and work on making a beautiful and fun childhood for OUR children. Be adult. EVERYTHING you do from now on MUST be weighed on the cause and effect on your child. Before you do something stupid, dangerous, or anything, you need to ask "could this harm my child?"

After that lecture... lol, sorry about that, I'd say they won't take your child away quite yet. The BEST thing you could do is stay off the marijuana (which I understand you say isn't often) and they will retest you every so often for a while. If you appear positive at all for Marijuana or any other drug, they could leave your child in state care.

I know you don't this to happen... so the best thing you could do is start shaping your friendships around what's best for your child. Cut or minimize ties with friends with drug habits. This will cut down on your child ever thinking it's okay to use, and will also cut down on your human instinct to do what other do.

I hope I don't come off wrong. I really am concerned and I can tell you love your child very much. Just make the best choices for yourself, because you choices affect your child more than you know, and I can see you've learned that the hard way.

First of all, smoking pot when you have a kid IS stupid and irresponsible, even if the kid is with a sitter. What if there was an emergency and you had to go home???

But to answer your question, they will probably tell you that in order to keep your child you will have to submit to random drug testing. My sister in law had to do this for a while - a social worker would drop by every so often and give her and her husband drug tests. If they failed, they lost the kids. Thank goodness they didn't - they've screwed their kids up enough as it is.

You will be taking it to court. You will have people testify on your behalf about how good of parents you are. If in fact it was your only time smoking pot you can explain that to the judge. Though i doubt it was your first time or the only time. Maybe the only time since your child.
You need to tell the judge you regret it and see if they wont take away your child. Children need to be with ther parents and if anything with their mothers. They will probably allow you to stay with your child but they will have a watchfull eye on you.
Dont worry relax. If you are telling the truth i dont think they will take them away. Unless they test your baby and find traces of second hand smoke, if they investigate your home and its not adequate.

You should have thought about the fact that your actions, effect your life and the life of a child, when you are a parent. Everything you do affects your child.
I don't think the CPS would show up at your door if it was just the case of someone saying that you had smoked a joint. There must be more to it.

Im not one to judge, but surely you should be more worried by the fact that you seem to view your marijuana smoking as a "one off" without noticing the serious implications that has, and also finding an excuse for it, "it was our first time away from the baby", especially when you have a baby on your hands. In relation to the question, i think this is a serious issue, and could be treated severely.

There is no such thing as smoking pot only once. Second, pefectly good parents don't use words like WTF, ecxpecially around a baby.

You did not smoke pot just one time. No one smokes pot just one time. Weed is illegal stop doing it, it will do nothing but get you into legal issues such as this.
You need to get a lawyer, these people have quotas to meet or their budget will get cut. If she canfile that she rescued a child from two drug addicted parents then she will. If you fight it I do not think you will have anything to worry about.

I had someone call saying I was smoking crack,knowing that it was a lie and eger to clear the matter up I took the drug test and it showed small traces of pot. CPS was involved for over a yr. Naive to what my rights were I complied with everything and it was never enough it always was something else. Finnaly educating myself and passing all future drug tests I refused a new worker into my home and she brought the police trying to intimidate me. I reported her to the FBI and my case was closed. MY advice learn your rights fast,document and record everything and never trust them.
