Police wont do anything about neighbours blocking my drive with drop kerb access what can i do next???????????

two doors down is creating problems for me to have access to my drive way. she pulls so close to my neighbours drive my neighbour ends up half way over mine. i have asked her to pull her car back but she is still creating problems being pulled so close. council say its a police matter and police say theres nothing they can do. where can i go with this???

I'd start by letting the air out of the tires, and if they don't get the hint, move on to more colourful forms of vandalizing the car.

the police is trying to fobb you off. It is an offence to block a private driveway,so the police have to take action.Failing that,go and speak to the neighbour.

If she is blocking the driveway, then it is a traffic matter. Demand that the police ticket her car. If they refuse, file a complaint against the officer(s) involved with the police department's internal affairs division.

Your neighbor should be the one to complain, since it is his driveway that is being blocked. You might consider speaking to the Planning Department to see if a portion of your neighbor's curb can be painted red (no parking zone). If so, this would give the police more power to enforce against your other neighbor.

Try not to get nasty about it, if you do it will escalate into something much bigger with neither of you wanting to back own and it will turn your life into a nightmare. I think you need to try communicating with your direct neighbhour because in fact it is their vehicle that is over your drive, the fact that the next neighbour to them is coming onto their drive is not your problem, but theirs, they can't just say 'well I have to park over your drive as my next door neighbour parks too near' that is no response, they are responsible for approaching them and asking them not to park so near, not you. You approach your direct neighbour and they approach theirs etc. Sounds like your direct neighbour is trying to pass the buck, if everybody did that then you would all be parking on next door's property and their would be a chain reaction. The first person in the chain has to be asked to stop.

To be honest, from what you say it's actually your neighbour who is obstructing your drive, not the person two doors down, isn't it? Then it's your neighbour who ought to take it up with her, not your good self . . .

there are a lot of good suggestions here like trying the police again, consulting a lawyer (which you shouldn't have to), talking to the neighbor (maybe making a joint police call).

whatever you do, don't damage her car. you are on record as a complainant and you might not fare so well if she hauls you to small claims or civil court for damages or even harassment. it won't matter how the problem started, don't retaliate like that.

Get pictures and tape or document your conversations. And it they run over a few nails, it's your drive.

it sounds as though she isn't committing an offence, just being slightly unreasonable. You fail to mention that she is blocking your or your neighbours drive. If she has a taxed, insured and roadworthy vehicle, then she is parked legitimately and the police are correct in doing nothing. Your neighbour on the other hand is committing an offence by parking in manner that does restrict access to your drive. Your neighbour may have to park elsewhere if there is insufficient parking.

Sorry to play devils advocate, I understand how infuriating things can be in these situations. Maybe all three of you should sit down and try to reach a compromise. This may actually help defuse a situation before it develops.

Jay has the right idea. Here is some advice from my experiences in watching this kind of problem snowball many times (sometimes into violence and outright murder):

First and foremost: Try to get your two neighbors into a meeting to discuss the issue RATIONALLY (no anger). You are going to be neighbors for a potentially long time, to start vandalizing cars and start a neighborhood war without discussing the matter amongst yourselves will only end in more problems down the road. Maybe there is a good reason that the neighbor down the street is doing this. Maybe the problem is coming from further down the street. Maybe there is some other reason that this is happening. A friendly meeting can defuse this situation and make for a better mutual understanding of each other's needs.

Second: IF that outright fails, forget the police, find the parking enforcement department of your city. Police tend to consider parking problems to be, well, unimportant in comparison to their other duties. This is understandable when you consider the other, more serious crimes that they are responsible for handling (like murder, rape, arson, etc.). But parking enforcement's sole duty is handling this kind of problem. Not sure how to get a hold of them? Try going through your city's Code Enforcement Department... They'll know. A few sweeps of the area by parking enforcement, and the subsequent fines, should get the point across.

If parking enforcement can not get a handle on this problem for whatever reason, you will have an available resource as to what that reason is, and can take appropriate action from that information. It is possible that the street parking arrangements are not up to code, for example, and the city might have to make reparative corrections (at some significant expense, I might add). The reports from your parking enforcement and/or code enforcement departments should help in defining the problem better and give guidance as to any next step that might be needed.

Hopefully the first step that I recommended above will help to solve this problem without further friction, though.

it is an offence to park over a driveway where the re is a dropped kerb. maybe u could do some research on it and then speak to the police again.

Unless there are local parking restrictions giving a right to a particular space, residents do not have automatic rights to a parking space on a public road. However, they do have a right of access to their drive. If there is a shared drive, then each person has a right of access and neither should block the drive. The local authority and the police have wide powers to remove vehicles that are illegally parked, causing an obstruction on the highway or which are abandoned. Speak to your local MP, if you are getting no joy from the Police and The Local Authority. If you contact your CAB, they will tell you who your local MP is. Failing that, contact your local media.

The police will still be responsible for moving traffic offences; matters of obstruction; and offences that carry an endorseable penalty, such as stopping on zig-zag markings at pedestrian crossings.

She must be blocking the drive not just making it difficult to get in and out.

Some councils have taken over the responsibility of enforcing
parking issues, as its a money spinner for them to fill their coffers, however, if your council have done this your driveway must be a legal drop kerb, with the appropriate permission, otherwise you may find yourself in trouble, and there would technically not an obstruction.

Look up the section on your councils web site to see if they have adopted enforcing this.

I agree with nanook. Go to your local library or police station and ask to see a copy of the city's ordinance codes (in ohio we also have the Ohio revised code, as well as individual town or city codes). It's definately illegal to block a private drive, which is what your driveway is. temporarily is one thing (say a fire truck or moving van), but if it's someone's personal car, it's illegal. go higher up the chain and ask for the police supervisor. make sure you have a cope of the town or state codes to fall back on. It may seem daunting to look up the code, but it'll be worth it. if they still refuse action, then I suggest letting air out of the tires!

It is a Police matter so don't let them tell you otherwise. It's obstruction. Take photographs and take them to the Police Station if necessary and ask for action to be taken.

If your driveway is blocked, I believe you have the right to call a tow-truck, to haul away the offender at their expense. Before you do that, and since the cops won't do anything, call them and ask them if you have the right to have a car blocking your driveway towed...

You might actually talk to the next-door neighbor and see if he is willing to have the nut-job two doors down towed when she is blocking HIS driveway! That would be the BEST way to illustrate to her that she is causing problems in the 'hood!

You know I know a lot of tow truck firms throughout the United States and there's a simple solution to this issue,and that is she'll being shopping for a new car after these guys get a hold of her present one. And even you won't know nothing about the whereabouts of her car or who took it either.

Buy a £150 car - an old banger. Use it as a "blocker". Even split the cost with your nice neighbour. Put the old banger wherever you want to reserve your place. I saw this done in Hackney - where the natives reserve themselves parking spaces every day outside their homes for their nice cars with cars they are willing to park on dodgy roads. Sell it when job is done and get your money back!!

This way you get the desired results without paying off the Student Loan of a low end lawyer who went to a rubbish University.
