Just over a week ago i was just finishing my shift in work at my local hospital when i went over to use the cash machine,while i was there a drunk man came out of the A&E and walked over to me, cornered me at the cash point, and leaned over me and sayd in a drunken voice, i dont feel well, i told him to stand back, he was making me uncomfortable, he repeated it again and this time i said, im not a nurse! he then punched me on the cheekbone, fell on top of me were i hurt the back of my neck, he then fell on top of me,were i had to push him off.i then called security and they phoned the police, he was arrested and is been charged with assault, im now off work,with a sore neck, and feel very nervous about going back to work, Ouestion is, does any one think i should sue the hospital, or put a claim in. Additional Details Im not trying to make a fast buck, as someone put it, we have a zero tolerance thing in our hospital, to help protect the staff, the drunk man was wondering around refuseing treatment, oh there was nothing wrong with him, only he was drunk, and the security were sitting in the room watching tv, and yes they do have to look out for the staff, i am only trying to get compensated for lose of earnings, i only work part time and not entitled to sick pay, why should i have to suffer because of a drunk man, and why should i be made feel guilty because of it, for those who have been nasty, maybe some day someone will knock you to the ground, and we will see how you deal with it.!!!

Weather or not people believe this, you can sue the hospital due to the fact that it is a state/federally funded institution that must protect the well being of patients/staff and the public. Talk to a Lawyer, they will tell you the same thing.
to all of those who kept saying "just sue the drunk, or you cant sue the hospital", sorry the world has changed, when an idiot makes it impossible or impractical to work, EVERYONE can be held accountable for others actions.
TO EVERYONE WHO IS GIVING NEGATIVE RESPONSES: WISE UP!! one day something will happen, it wont be your fault, and there will be nothing you can do about it, but something will happen horribly someday. like what happened here there WAS someone who could do something about it and they did nothing now a person is hurt. It is not like she is blaming another person for something that she did to herself, a DRUNK PERSON HURT HER ON HOSPITAL PROPERTY AND SECURITY WAS TOO LATE TO REACT. the hospital is responsible due to the fact that they have security within the hospital. read up on the laws. any establishment that willingly or forcibly has a security system/person force is responsible for the safety and well being of all persons within said establishment. |

Sue the guy who punched you, it was not an accident to which the hospital were responsible so I don't see how they can hold any blame.

Compensation should be sought from the man who injured you. Try not to let this incident affect your life, think of all the times you went to work without any problems. It's hard, I know, but it's important to get a perspective on this. Good Luck! |

it really angers me, when people like this abuse the very people that are there to help them! What is happening to this country? Im so sorry that you were attacked in this way hun, its dispicable.
Personally i would not sue the hospital, but i would press charges against this horrible excuse for a person, and sue his butt!!

You are better suing the man also claim compensation off the criminal injury board as you have lost time of work etc keep all records of everything police number the lot.
I hope you feel better soon and do not rush back to work they will have Occupation Health for you to go and see and talk this through. |

See a solicitor, the only way you will get money out of the hospital is if you are able to show they should have taken action against him prior to him assaulting you. If it was obvious to anyone that the guy presented a threat, the hospital should hve called the police BEFORE he caused trouble.
If the guy who assaulted you has any assets, you could sue him. |

In the USA, you have two things to consider:
-Criminal charges against the drunk, for the crime of assault and battery.
-Civil charges against the drunk, for the liability (monetary damages) against you.
In either case, the hospital is not the party you are charging.

the man will be proven to have asaulted you via police records. you can sue him. The hospital have a duty of care towards you a you ar employed by them and part of your duty is to be able to get food from the machine on there premises. Although the hospital is not directly responsible they have to assist you for an injury whilst you were on duty. I am sure the actions of the security staff would be very much in question if the man had assaulted a member of the public. You are entitled to no less protection. Sue the man then contact your union they will know because unfortunately assaults on hospital staff are common these days. Put a claim in as an assault/injury on duty. The hospital know that drunken louts cause trouble in A&E therfore they have to provide proper protection. As staff are not trained in self defence yet assaults are common. |

Perhaps we could sue the estate agents we purchased our homes from following a robbery.........sue parents for our existence..............sue God himself for the crap weather were having! Its terrible whats happened to you, however, trying to find blame with the hospital seems despicable. Perhaps its shock, if its not, you should work in a bubble or on cloud cuckoo. Sorry but that's my opinion. I hope your injuries will recover quickly, I'm sure the care and treatment your receiving is invaluable. well, if you take action against the hospital you work at, will sure make things uncomfortable if you want to keep working.
on the other hand, they should not have allowed this man to roam around. that's what security is there for. so, i would file a complaint and ask them to cover my off time and all my medical if they haven't done so already.
and you said your feeling nervous about going back. you should seek a psychologist. you've been assaulted and are feeling experiencing anxiety. i wouldn't let it go unchecked.
i had a similar experience where i was assaulted (grabbed only), and ended up having agoraphobia. couldn't go anywhere alone. had to have a babysitter all the time. this went on over 10 years!

get a lawyer so they can explain your options. sounds like you might have a work comp claim. hey to all the idiots who say sue the drunk. you're dead wrong. you can't sue him. its a work comp claim against the hospital. you can go after the drunk for assault and battery. |
