My x, the father of our 2 kids, had his gas shut off this last week....I just found out after the kids came home from staying with him for the weekend. I asked my 9 year old this morning if he had taken a shower at his dad's this last weekend and he told me no...we had to wash our hands in cold water because there wasn't any hot water!!!
What legal right do I have as the primary parent to keep my kids from going over there till he has gas for heat and hot water?!?!

There isn't a fued between us....we get along fine. No, they won't die without a shower for a day...but they spend several days with him. We live in nothern Michigan and if you check the weather reports--we still need heat! It was 34 last night!

Have DCS do an audit on the home, there are certain requirements for habitation. Power, water and electricity are required. Call you lawyer and tell him whats going on. |

The custody of rights of the other do not include keeping the children in a premises that are legally not habitable. Lack of heat, water, electricity, or food would be an adequate reason to refuse to allow the children to go to that place. Your ex can take you to court if he feels this is an unreasonable requirement. He won't win as long as you can demonstrate that your reason was based on well founded belief that there was no heat... |

Will it make any difference if they dont shower for a day? Will it make a differance if they have to wear a sweater or use an extra blanket? Dont make waves that will harm your kids relationship with their dad. the fued is between u and your ex..keep the kids out of it. |
