yesterday I was sprayed in the face with pepper spray. Is this considered aggravated assult ? unlawful discharge of chemical weapon ?

There is a specific statute on this. Use of a tear gas weapon (which is the technical term for pepper spray in California) other than in self defense is a violation of Pen C section 12403.7, subdivision (a). The charge can be filed as a felony or a misdemeanor. As a felony, the maximum sentence is three years in prison, as a misdemeanor the maximum sentence is one year in jail. If the weapon is used against a peace officer in the performance of his or her duties, it cannot be filed as a misdemeanor.
