My stepdaughter's mother currently lives in VA, and me, my husband, and his daughter live in TX.
Custoday was established to the mother in VA back in 04 only because my husband never got the summons to appear in court, and he didn't show up. So custody went to her by default.
The mother spent 8mnths of 2008 in jail, and when she got out of jail in July, she moved an hour away from her daughter and saw her daughter twice since then. In November of 08 my husband picked her up and bought her back to TX with us.
We've had my stepdaughter for 4 1/2 months now (of course the mother hasn't seen her), and I heard that after 6mnths if a parent does not see their child it is considered child abandoment and it would make it easier for us to get custody. Does anyone know if this is true??Would it help us in anyway? She hardly calls, doesn't send anything, and isn't on child support
Additional Details
#1- We didn't kidnap her The mother called us and told us to come get her and that "one day a long time from now" the little girl can go back to "mommy".
#2 The mother was in jail for writing fake checks, giving a false identity to police, selling drugs.

You need a family law attorney. The fact is the mother has custody, and the father is guilty of parental kidnapping. He needs to protect himself now. |

Who is we? There is no we in this case. It is the father and mother, you may be married but you are not involved. If ever you attend a court proceeding concerning support or visitation NEVER NEVER say we.
child abandoment is one year and you better have good cause. Judges lean toward woman so unless she is a murderer or rapist abandoments charges dont fly. |

Ask a lawyer, custody cases are very tricky. And most states have different stipulations on what is child abandonment and what isn't. |
