Question about going to court?

To start off im 14 im a freshman in highschool and im willing to miss a day of school because my mom has to go to court on the 28th this month because of our house going to foreclousure or not it was suppose to be in foreclosure last year in the summer but we've had help and it has been delayed till now. My mom cant speak english and i was wondering if it was possible for me to represent for her so i can plea our case



and please dont say get a translator i doubt its not even free

You cannot represent your mother. She may well be entitled to an interpreter. Call the clerk's office and ask. If it's Spanish, interpreters are often permanently available, depending on the interpreter's schedule.

Do not interpret for your mother. Legal jargon is difficult enough for trained and experienced interpreters. You will only cause harm to your mother's case.

There are few defenses allowed in a foreclosure. Inability to pay is obviously not an acceptable defense. If your mother has made payments not credited to the account, if there are fees and charges that are unreasonable and that caused her payments to be inadequate, those are valid defenses.

You don't say what state you are in (or country) and it's not clear what kind of hearing is scheduled. There may be free advice from a legal services office in your state, even representation. Call the local, county or state bar association lawyer referral service for help finding it.

Translators are free at court. It's a basic right to be understood, so the court will appoint one.

However, feel free to go with her - she could probably use support.

Interpreters can be provided by the court like lawyers.


Just ask the court for one but go with your mother as well for some family support.

No you can not represent her. The court might let you sit with her and make sure she understands what is said. Wishfully you and your mother could understand that only the holder of the original note can foreclose. You could offer to pay the note in full upon receipt of the original note and paperwork. This would stop the foreclosure until they produced the original. A note is a negotiable instrument and payment can be demanded only if the original is produced. The institution which you took the note has sold the original and can not produce it. Therefore, you can not be required to pay if you demand the original. No one will ever know you don't have the money to pay if you just stick to your offer to pay when they produce the original. Good luck.
