My best friend has gone through a terrible break up, and this terrible lying man of hers has just drug her through the mud - (he threw her out because she was seeing a married man,etc - NOTHING could be further from the truth she is pure as the new fallen snow, he was simply an abusive, lying cheating a**shole and she had enough and left him!).
Anyway, I would like to set the record straight, based on police reports, actual facts, etc - my friend had said "it is too bad somebody couldn't" - and I have taken it from there to find out HOW to do this but not wind up sued, doing time or on probation over this while he finally gets the truth told about him! Please help. Additional Details I appreciate the input - it seems I was correct in thinking if it was truth, it was alright. I simply want to put facts together (not run my mouth in lies like he does) but show facts, police records, court records, etc (which in my thinking would be public record anyhow) but the manner I intend to put them in will look make him look like the horses *** that he is.

You need to understand something. There's a huge difference between being liable and being sued. Regardless of the truth of your postings, you can be sued. If you are sued, you will need to defend yourself in court and this would NOT be a DIY defense. You would need a lawyer - a lawyer who knows how to defend a defamation case. The lawyer will charge by the hour. The cost will be enormous. If you choose not to respond to the lawsuit, the plaintiff wins and gets a judgment against you. If you choose to DIY it, first, the time, money and energy you will have to expend will be more than you can believe and, if you screw up, the plaintiff will get a judgment against you.
In this country, anyone can sue anyone for anything or even nothing and the cost of defending yourself can be crippling. |

Truth is 100% defense against libel and slander.
But you must prove -- BEYOND A SHADOW OF A DOUBT -- the stated or printed allegations are true.
This is one of those situations where the de-facto civil quantum of proof is pretty close to criminal. Civil courts take a dim view of trash talking and will punish, if possible, the one doing the talking.
I would stay the hell out of this if I was you. You have no way of determining what is true and what isn't. And it isn't your fight.
But you can forward this advice to your friend as a starting place. |
