Is it slanderous to refer to someone as a child molester if they have not been convicted in a court of law? Even if my own child told me what the person did to them? I believe my child. What legal consequences could there be if i refer to this monster as a child molester?
Additional Details
the accusations were made by my 5 yr old. heard it with my own ears. unfortunately, my child did not offer up the testimony during the CPS investigation or in their on going therapy...yet.

In reality he would have to prove damages(i.e did not get hired due to the accusation.) But, he would of course need a witness to testify.
Chances of a lawsuit are not likely, but I do not advise that you slander anyone. |

If he proves what you said damaged him in some way he can take everything you've got. |

In my own state there is a defamation law which states essentially "Any person who writes, prints or speaks of ... another any accusation falsely and maliciously importing the commission by such person of a felony or any other indictable offense involving moral turpitude shall, on conviction, be punished by fine ..." which would apply in this manner in your question.
If the person has not been convicted of child molestation, then he/she is innocent until proven guilty. Any comment relating they "were" or "have been" etc would be slanderous! |

If you openly call this person a child molester before he is proven guilty, the person can sue you for slander and defamation of character. Even calling someone a child molester can ruin someones life. Even though I'm sure your child is being honest, I wouldn't risk the legal ramifications of calling him a child molester until he is convicted. |

You could get sued for Slander, but since Truth is an absolute Defense against such a lawsuit, anyone planning to sue someone for calling them a "child molester" would do well to think about what happened to Oscar Wilde when he brought a similar lawsuit. |
