My father died in september of 2007 and left me money on his will . well for me and my sisters. his life insurance policy was for 100,000. and the person as his beneficiary was his wife. which is not my mother. she was supposed to pay for his funeral and then with the money left over split it 3 ways between us . i never heard from the wife after that and found out that she lives in New mexico.. or maybe she went back to Mexico. im trying to find out if there is anyway that i can still get the money or is it to late? thank you for your answers.

Get a probate lawyer in the county where the will was filed, have him pull the final probate accounting and he'll tell you the state of play. |

The proceeds of a life insurance policy go directly to the beneficiary not to the estate so it never goes through probate. If she was the sole beneficiary that's it. It's her money and she's free to disregard his wishes. If there was any money or property that you think was bequeathed to you in the will that you did not receive you need to go to probate court and get a copy of his will and then speak to the executor to find out what happened. Get a probate lawyer if his wishes as stated in the will were not followed.
If it was his wish that she give you and your siblings the money he should have made his estate the beneficiary with you named in the will as an heir or made you and your siblings beneficiaries of the life insurance policy in any percentages he desired. I'm sorry to say this looks like another case where the deceased assumed his wishes would be followed by someone he trusted and so did not expressly state in his will what he wanted, and someone got greedy. It happens all the time. |

well, if it says on the will you were supposed to receive money and she did not go through with the will find out where she is get a lawyer and sue her for not goin through with your fathers wishes |
