My BIL(Brother-In-Law) lives with us due to his problems back home in California. He has 4 DUI's and has had his license revoked before the age of 20. Yeah, a very irresponsible kid. But anyway, I was curious as to what the law is here in Washington or in any state about trying to obtain a license in Washington though his California license is revoked.
I mean, let's say he goes out and takes our car one night and gets pulled over for whatever reason and he has no valid license with him.. Will he just get a ticket and pay a fine? Or does he get in more trouble than he did before?
Also, I neglected to mention, he is on parole in California and my bright husband decides to bring him here to protect him from getting "killed" in California since he was stabbed two months ago.. I mean, does another state have all that information about him? I really need to know about this because my husband thinks that Washington has no access to his records back in California but I think otherwise and I have this feeling that once he messes up, I'm afraid we'll get in trouble. I seriously don't want any part of this mess as I have my own issues to deal with. If you can, please let me know the following:
(1) Can he obtain a license from another state even though his was revoked from California?
(2) If he gets pulled over in Washington and the officer discovers that he doesn't have a valid license, what will be his punishment and would that involve me and my husband as well?
(3) Do other states have access to records such as someone being on parole or having a revoked license?
(4) Is it illegal for him to leave a state in which he is on parole for? And what is the extent of his punishment if he gets caught?

I'm not an expert in matters like this ... but it seems like your BIL is looking at some trouble!
Washington State will have access to all of the California information, revoked license, parole, the whole works.
He will not be able to get a Washington license until the revoked period ends in California.
If he gets pulled over driving without a license, the car will probably wind up in the impound yard and he could wind up in jail. Since he is driving with your permission, you could be charged with letting him drive without a license.
If he did not get permission from his parole officer to leave the state it is probably a parole violation for him to be living in Washington! If he gets caught, it's back to California prison for sure.
He needs a lawyer to help him out. Get permission for him to move to Washington, his parole can be transferred if Washington is willing to accept him. Make sure he understands under what conditions he can get a license, and make sure he does not drive your vehicles until he gets one! |
