You used to be able to sue for alienation of affections. "However, since 1935, the alienation of affections tort has been abolished by at least 39 states as an archaic and outdated form of revenge. Since most states have abolished alienation of affections, wronged spouses have tried to recover damages under the cause of action known as intentional infliction of emotional distress (IIED). Courts have generally recognized IIED as separate and distinct from alienation of affections, so that IIED may be available against a third party for conduct that breaks up a marital relationship, even in states that have abolished alienation of affections."

In every state. You can file suit against almost anyone for almost anything. Whether you get anything out of it or not is a different matter. |

Home wreckers don't have to deal with any of the fall out they cause....maybe being able to do this would make those people with "happy pants' think twice.

I don't know....but I thinks it's a darn good thing. I usually don't go for the suing thing but, having recently been cheated on.........I wish I could nail her butt to the wall....his too......I blame him more than her, but what a nasty woman. |

However way to go at revenge. I suggest she sue BOTH of them and they both pay for damages. I'm sure this woman had to pay at their hands. |

There are a couple of states that technically have these "alienation of affection" laws still on the books, but they're rarely used. It also seems to me that the chick on that show was full of it, or lied about something, because certainly if she can prove or even demonstrate that she didn't know the guy was married, she could have avoided paying anything in that lawsuit. If she didn't know, that's pretty much the textbook definition of an affirmative defense to that action. |

You can sue any one for any thing. Whether or not you actually have a case or not is a different matter. All you need is $300 and a lawyer to file a lawsuit.
This is why there are so many stupid lawyers out there. Too many greedy lawyers are willing to just charge idiots $200/hr. to file stupid lawsuits. Even if you could fight the lawsuit and successfully counter-sue, you're still going to end up with your own $200/hr lawyer - and for what? So you can extract money out of some idiot who doesn't have a dime to his name otherwise? Oh, and then there's the years and years this whole process will take... |

Well sounds like you need a lawyer to answer this on.
But for real the only one that's guilty here is the judge and his religious beliefs. Think about it! If you fart in public someone in the future will be able to sue. The judge should lose his judge-ship: The separation of church and state is the real issue with a judge playing soldier of God. |

Maybe she settled, just to get it behind her. Cheaper to settle sometimes than it is to get an attorney and fight it even on a frivolous lawsuit. |
