Scenario.. have own bank account and paid for lotto ticket with own money. If i win is my wife entitled to it?

wife want's to devorce and is trying to get me commited

If the bank account is community property, regardless of whose name is on the account, if it is a community or quasi-community property state. She gets half.

If she is trying to get you committed, don't worry about the chance of winning at lotto, which you are not going to win anyway.

Under most state laws, money is a joint asset if it's in the bank, so yes, she would be entitled if you won and put it in the bank.

It's all yours until you die or get divorced. If she manages to get you committed you still get to keep the money.

If you are married, you would have to split in half...but as far as I know, if you have prenup, then you would be able to keep all the money to yourself...

Make sure to definitely consult a professional CPA or a lawyer for specific advice regarding this...

I think this depends on the state you live in. Is it a community property state? If so, half is hers if you bought the ticket while you were together. I am not sure what having you committed has to do with this all, but what reason would she have? She can if you are doing something that puts you or someone else at risk. So if you are....STOP! if not, then she would have no legal means to put you away. You are an adult and if you are truly not needing to be committed, a psychiatrist would see through any divorce plot. best bet, always tell the truth and be your self. If you are being the best person you can be and following the golden rule then you should have nothing to worry about. It is lying and deceiving that will get you in trouble in the end.

It depends on the state you're in, and also if you've already filed for "seperation" with the court. Generally once you file notice to seperate your assests and considered divided unless you reconcile. (This has no barring on how the final decree will split up assests, just that what ever money you make from the point of filing to seperate is yours and not "community" property.

Again this varies from state to state, not just on if court papers need to be filed, but on if property is considered seperate or community.

It depends on the state.
In Oregon, a wife is entitled to half of all property aquired after the date of marriage unless it was a gift such as an inheritance.

A lottery winning would get her half of it.

She can't have you committed unless you are dangerous to yourself or others. It's not an easy thing to do.

Again, this is in Oregon.

Well, this depends on a lot of things. (You don't say where you are from).

First, when did you separate? If it has been recent, no longer than 6 months, and during the marriage it was the norm that you'd buy the ticket in the same way as you have done now (ie: from "your" money), then your wife would be entitled to a share. If you've been separated for much longer, then you need to argue that the winning ticket was bought with post-separation earnings so therefore it is 100% yours.

Secondly, how long was the marriage? If it was marriage over 7 years then it is considered a long marriage and your wife may be entitled to a % especially if there are children of the marriage and those children are still dependant on the wife for support.

Thirdly, you say its "your" money? Nut what was the deal during the marriage? Did you and your wife keep completely separate bank accounts and what you earnt you paid for etc and what she earnt she paid for? This would mean that even though you were married, you NEVER bought anything for each other? If this is the case, then her entitlement to the ticket is slim. BUT, even if you had "your" money and "her"money and no "our" money, did you ever buy gifts for your wife and share expenses? If so, then she would be entitled to something.

The bottom line is even if you are separated, given the length of the marriage and the difficulty in proving the stuff I have mentioned above, and especially if there are children, then your wife would be entitled to something. Its not clear cut on the exact percentage because you need to take into account all your other assets and liabilities. For example, a million dollar ticket when you've only got a $100,000 in assets is huge. But if you're already sitting on $10m of assets then $1m is nothing. Speak to a solicitor.

It depends on your local and state laws. In some states, all things that you or your wife own when you become married become common property. You would either need to agree that the other can have the items in question or split the worth of the item. Most likely she will get half.

If it's a large amount, keep that information to yourself. If she already knows about the ticket, she can claim half as community property. She can file for divorce, but to have another person committed isn't as easy to do. If it's obvious it can't be worked out between the two of you, get it over with and move on with your life.
You and I know the only two people that can afford an attorney is another attorney and a plumber. Get an attorney so she doesn't screw you any further and let your attorney handle everything for you. For the sake of argument, I hope there isn't children involved in the divorce. They are the ones that really suffer and sometimes blame themselves for mommy and daddy breaking up. Good luck.

Presuming you were still married when you bought the ticket, she is entitled to at least half!

(But she will, in all probability, receive more!!!)

Well technically in a marriage you share everything 50/50, unless you have a prenuptial So I guess she entitled to half but I don't get what that has to do with being committed. To where a mental facility? That wouldn't effect your half of the money...or I'm I totally off course??
