Hi, my husband and I live in Belgium and have done for 13 years. We ran our own business since we moved here, but due to the economic climate it failed. Now my husband claims unemployment benefit. However, because he does not speak Flemish, the unemployment people said he must go to school to learn the language (he tried this in the past, completed the course but still couldn't get to grips with it). He enrolled in the school, but then he had a problem because the teachers were allowing students to smoke inside the school during break time in violation of the anti-smoking law here. My husband complained to the teachers but they did nothing. He made a formal complaint to the school director and said that unless they upheld the law and stopped people smoking, he did not feel he could come back to the class. Now, the unemployment people say that unless he goes back they will stop his payments. The school is breaking the law and he is being punished. Can they legally require him to be exposed to passive smoking (contrary to the law)? Does he have a legal right to refuse to go to school because they are breaking the law? He is not a slacker; the fact that he ran a business for 13 years shows that. Any help or advice would be great. Thanks
