School threatens to file truancy in Michigan help please?

Hi everyone. i am in a bad spot i think. im 16 years old -which is the legal age to not attend school- school has been in for 9 out of 10 months and i have missed 24 days / 1 month of the other 8 months ive been there and they want to file truancy against me i have questions about this.

1.if im legally of age to not attend school as it is can they file truancy against me -its a public school district not private so they are not losing money by me not going a few days-

2.i had a illness for around 19 of those days that prevented me to go to school -PERIOD- ALSO i have a doctors note and a written legal document from my doctor saying i was under his care for the days but the school says they wont accept it? and will still file for truancy.. is that illegal?

3.last but not least. michigan law states a student attending a public school is allowed to miss 10 days out of the 10 months of school... so after my excused absense doesnt that mean i technically only missed 4-5 days of school since i have a doctors note and written document from him?

my doctor said he would confirm it in court if it came down to it but im wondering if they can do all that when i legally misssed 19 of the days and would still be considered UNDER the 10/maximum days aloud to miss.

I used to work with someone who was charged with truancy even though he was over eighteen (the age of leaving school in my state). So I suppose it's possible that the school will file truancy charges, although it would be stupid and a waste of time.

But they won't get anywhere with them. The age of leaving school in Michigan is sixteen, so provided that your absences were after your sixteenth birthday, the worst case scenario is that you will go to court, show the judge some proof of age, and get the charges dismissed.

And if you were under sixteen at the time, the school district has an obligation to provide you with an education whether or not you are healthy enough to attend school. They are within their rights to think that nineteen days are too long to miss school, but they must provide an alternative if you are too sick to go. (This is usually a tutor sent to your home.) Since they didn't do that and your doctor said that you should not go to school, they gave you no other option but to miss school. This isn't the kind of situation that truancy charges are designed for.

I expect that either way the charges, if filed, will be dismissed.

they probably won't go through with it...truancy charges cost the state district attorney's office money...money that isn't worth getting you into trouble..because they either want you in school, not juvi, or they want you not in school, so who cares if you missed class. i explained that weirdly, but do you know what i mean? if it comes down to it, state that you no longer intend to go to school, attempted to come the majority of the year, and have explained absenses from the classes you missed. seriously, michigan has bigger problems than some kid skipping class. keep your head up buddy, you're fine.
