Seat belts in the back seat?

what is the seat belt law in texas? specifically, is it legal for a person over 18 to be in the backseat without a seat belt?

our moms car has only 2 spots with seat belts and i always choose the one without as we have heard that anyone 19 or over is okay in the backseat without one and i am the oldest.

so is it true?

spare me the seatbelt safety speeches please. i wear it most of the time, just not in her car. it's way more comfortable to just not wear one.

Texas child passenger safety laws require children younger than five years of age and less than 36 inches in height to ride in an approved car seat or booster seat. Additionally, Texas law states that during the operation of the vehicle, the child must be properly secured in a child passenger safety car seat system according to the instructions of the manufacturer of the safety seat system. Children under age 17 must be buckled into the vehicle with a seat belt. This law changed on Sept. 1, 2005. The new law increased the age requirement for child safety seats from four to five.

Yes you should be OK. The law does say that anyone over 17 is Ok without the seat belt in the back.

I too live in Texas, and your not required to use the ones in the back seat, but you would be wise to use them. They were put there to save your life and keep you in safely in the car. If the car were to flip, you would be thrown out the window without them and likely be killed from the impact, whereas if your were wearing them, you would likely just have a few scrapes and bruise (if any at all). 20 or 50, it doesn't matter, if you get into an accident and don't have your seatbelt on, you may become a statistic.

I know a guy who die in an accident because he didn't have his seatbell buckled.
Which would have prevented him from being thrown out from the taxi and hit his head hard on the concrete.

i believe in most states it is legal to ride in the back without one. but having been in a horrible car accident in my life i recommend you wear one whenever you get a chance.

yeah its fine for someone to not wear a seatbelt in the backseat if you dont care for their safety.

i live in texas too, and i dont use the seat belt in the back seat. i dont think it really matters, since the police always let us pass. uber weird huh.

I believe it's ok to ride without one if you are in the back seat but I always just wear one anyway out of habit. Even if it's a little uncomfortable, it significantly increases the chances of survival in the event of a bad car crash. After seeing one of my friends die in a car accident and being ejected from the vehicle for not wearing one I would feel guilty not putting one one.
