Seniority? What are the laws?

Ok so I work at this liquor store and an older lady that also works there is always throwing seniority up in our bosses face. So the deal is the boss suspects she is stealing but cannot prove it. However she has dropped her hours and the employee is saying that they cant do that because she has seniority. What is the law about all of this seniority stuff?

There are no laws regarding seniority. I've heard of labor laws that concern seniority in the US post office (they can not fire any employees that have more than 5 yrs seniority) but never at a liquor store. Also in the military, if you go on a deployment, the employer has to keep a position similar or the same as when you left it. You still keep your seniority over new employees. Seems as though she's just throwing that word around to intimidate the boss.

"Seniority" is meaningless in 99.9% of non-union jobs. But it's gonna depend on the state you're in, since a lot of states run monopoly liquor stores (ABC stores). It's possible, if it's an ABC store, that the state has some strange union type rules for senior employees.

Check out your employment manual. If you don't have a copy, ask for one. It should cover 'rights, rules, responsibilities' type stuff.

Every state but MT has employment at will. UNless she has a union protection, or contract, as long as she is making minimum wage, they can do pretty much whatever they want as long as they properly notify her.

There is no law. If there is a contract that requires preference for those with seniority, it can be enforced. Such contracts are a matter of negotiation, not law. There is a law that restricts discrimination based on age, and it applies to those over 40, but that only prohibits decisions based on age, not performance.
