What would be the sentence for an individual who attacked a family member with a barbecue tool(the thing used tp pick up the food,i dont know the name)They said it was an assault with a weapon.The family didn't press charge but the police did.
The perpetrator has absolutely no history of violence and no criminal acts whatsoever.She was also under the influence of alcohol during the act and has a big alcoholism problem.The victim only has a minor scratch on the arm.
Will it be jail?A fine or probation,etc?
I live in Canada,Ontario but even if you don't live here,i know the laws are different but what would the perpetrator's sentence be where you live?

It really depends on the case, the jurisdiction, the prosecuting attorney. It also depends on the relation of the family members. If this is a troubled daughter who has an alcohol problem and other troubles, the prosecutor may be inclined to work out a deal, get her alcohol counseling, drug counseling, community service, probation ... instead of jail. Get a good attorney who makes a good case, highlights the lack of violence, addresses the alcohol issue, and makes no lame excuses. Have her take responsibility and fess up to her derailed life, and system may be much more inclined to want to help her. |
