There are thousands of people who deal with faulty products and never say anything because they don't feel like making waves or it was just one that was bad. I would look into the product / manufacturer and see if you can find any other instances where this has happened. Either way, I would talk to a good lawyer, not one that you see advertised on TV. I feel badly for you. Good luck. I don't think this is a frivolous law suit. You have had to deal with too much because they made bad products. |

My husband is also an insulin dependent diabetic for 30 years. He has never had this problem.
I can understand why you would be so frusterated. However, I doubt that the pain and suffereing that you are experienceing was intentional.
I would not sue UNLESS there are several other cases documented. If there are other cases then the company should be held liable, however if no other cases are reported, accidents do happen.
Just my opinion. Good luck with whatever decision you make. |

It appears to be a manufacturer's defect. Check the manufacturer's website for any recalls or any complaints against the manufacturer of your brand of needles. Also, check the FDA website as well (if you're in the U.S., which I assume). Then, seek legal advice as to what your next steps should be. |

This sounds like a great products liability case. But you don't have to take my word for it. Present these facts to a person injury/products liability lawyer. Lawyers get paid only if you collect money. That means that they won't take a case they think is frivolous or destined to lose (or destined to just not make very much money). If the lawyer you consult will take your case, you know it's a good claim.
And remember this - by suing, you are doing important work. You are protecting all of the consumers (diabetics and others) who come after you. You are making sure that the products they depend on work the way they should. And that's a darn good thing to do. |

At the least of course you should get all of the surgary paid, and a small offer for your suffering. ( I would be surprised if they don't come to you with that) But heck why not, you do expect to get proper needles |

I'm sure you can sue. Just go see Doowe Cheatem and How. I can almost guarantee that if there is some money to be gotten they know how to do it. Now on my serious side, I'd say no. I'm sure that they didn't produce or make this syringe faulty on purpose and that there was NO WAY possible for them to know this would happen. |

The question is, is it worth suing? Anyone can sue, but not very many win.
At this point you only know the needle broke off. You don't know if it has happened to others or if it is a known defect that the manufacturer just didn't find it worth correcting.
It sounds like you will, after the major surgery, have enough medical expenses to qualify for pain and suffering, although I can't be certain without knowing what state you're in. It would also help to know your age and if you will lose any wages from being in the hospital.
After the surgery, consult a good medical malpractice lawyer in your area or an outfit like Lawdocs. |

you can sue them, but i think there would be hassles. it never been easy, the lawyer, the court, trial delays..and the cost you have to bear. if you think you can pass all of it, then do it. |

sue them if one of the eight didnt work and it wasn't because u abused the product it was completely there fault then u should sue for at least what it will cost for your surgery and the money you will lose from being on disablility they deserve it for not making a safe product |

I would talk to a lawyer (one that is reputable and honest) to see if he/she thinks that this is a case of negligence on the part of the manufacturer. In other words that they did something wrong or negligent that contributed to or caused the defective needle. If it is considered to be negligence then yes I would sue. |

not to be greedy but you should at least recoup the costs of doctors etc.. and a little for your trouble. try calling an established lawyer and ask a few questions. |

you can do wht those folk before me said or you can really help out the folkd just like you out there and file a class action suit, chances are there are a lot of folks out there that experienced the same problem, but other wise unaware of it and think that it was their fault or something. |

I would contact the company and see if you can figure out a settlement before suing, but having a lwyer would definitely help put some weight behind you.

You are right when it comes to people suing others it is like an epidemic, if something goes wrong then just sue them. I think every situation is different like yours I mean you have suffered because of this and you are going through alot. Not only are you probably in pain but it isn't cheap to go to the doctors ect.... ect...
Maybe this was a one time thing but maybe it has happened before to others so I think you should check into this and if it happens alot then sue them because it probably will happen to someone else. |
