Should I press charges or what should I do?

I just had to take my son to the E.R he has a fracture proximal left humerus, and angulation of fracture is present..

His ex friend was riding by on his bike when he saw my son climbing up this fence to get this girls shoes my son is 9 and the ex friend is 9 also but the size of a sumo wrestler anyways the kid "ghost rode" his bike (jumped off while it was still going) to go and pull my son down off the fence and he fell of of course and broke his arm.. This kid always starts problems, my son is TINY for his age and this kid ALWAYS picks on him.. Should I press charges or what? Talking to his parents is like talking to the grass.. . just no response at all.. Im really tired of it and what I reallly want to do is just go over there myself and seek my own justice with my baseball bat! I told that kid to stay away from my son and his parents .. what should I do? He has to see a orthopedic surgeon tomarrow he might have to have surgery.. They need to make their son realize what he did wrong RIGHT??? If they wont how can I?

Like others have said, file a police report and have the police officer talk to the kid and his parents. I don't think pressing charges would be appropriate, since he is only 9, and that is the sort of thing 9 year olds do. However, you can sue the parents for the medical expenses, and possible exemplary damages. Shelling out a grand or so for their son's shenanigans would surely get the message through to them.

File a civil suit for your medical expenses or, better yet, ask your insurance company to do it for you. Absent witnesses, it may be a tough case, but talking to the other kid's parents sounds like a waste of time.

I'd call the police or sheriff and ask to talk to an officer for juvenile affairs. You can discuss what happened without pressing charges. He/she may go talk to the goon and his parents, make a report, etc. Worth pursuing. Yr son's injury is serious, and it could be worse next time.

YES, you should/can definately press charges. If it was completely the giant kids fault, then you can press charges, and possible get some of the medical bills paid for by the family. Sometimes, however, your insurance company might demand a sue so you can get the money to pay for the medical bills (if you don't have enough.)

This sort of happened to my uncle, he was in a motorcycle accident, and a car cut in front of him. He broke his upper right arm, right elbow, left wrist, left fibula, a collapsed lung, loss of memory, shattered jaw and facial bone, and the insurance company demanded that the woman who was driving the car be sued so the medical expenses could be paid for.

Maybe you can get a police officer to talk with the boy and his parents.

I'm sorry your son broke his arm. I'm sure it's going to be a long night for you and him with his sleep interrupted by pain. Elevate his arm on an extra pillow to prevent some of the pain.

He's 9, they probably won't do anything. If I were you I'd take the family to civil court and sue them. That way they'll definitely learn a lesson.
