Should I sue?! Do I have a chance?

My father went into the hospital after suffering cardiac arrest. He had blockage in two of his arteries, one 70% and the other was 93% though we didn't know it was that bad at the time. They put a stint in the first artery (70%) and we thought he was going to be okay. They gave him a stress test, said he was doing better but they wanted to build his heart strength back up before putting a stint in the second artery. They took him out of PCU (Primary Care Unit) and onto a regular floor....with no heart monitor.

He suffered cardiac arrest two days later. They didn't find him until it was too late. They managed to revive him and he had too much brain damage.

My question is....could this be considered negligance, knowing he had such a bad heart condition, but still putting him in a room with no monitor? Do i have a chance if I go at them? They've been featured in the newspaper (the hospital) as having a lot of money but poor care for patients. What do you think?

Oh yes, when i say he had brain damage too badly, I mean even if he had lived, he would have been a vegetable. His heart was too weak and eventually just gave out. :( This was four months ago. Statue of limitations on this?

You need to consult a medical malpractice law firm. They will be able to advise you on the liklihood of success. If they believe you have a strong case, they will handle it on a contingency basis, which means that that they will get paid only if and when the recover money. Some firms will handle the case on a partial contingency meaning that you might have to come up with some money while they do a preliminary investigation, if after their investigation, they determine you have a strong case against the doctor and hospital they will take your case on a contingency basis. Talk to several firms about the case and do not listen to all the nitwits online that are telling you that there was no negligence. They have no clue as to what they are talking about. You need to confer with medical malpractice attorneys. And, do not feel bad about taking legal action. Taking legal action against bad hospital or doctors is the only way to ensure that they will provide better care in the future. I am very sorry about your loss. I lost my father after he wasn't able to recover from heart surgery as well.

yes, you do have a chance. but if i was you i would console my laywer before anything, you may be able to get some money.

and you should know that since they have a lot of money at there disposal they can dodge you for awhile so you need to be commited to spending a lot of dough.

your dad has a bad heart, either due to poor health habits or genetics. the doctors try to help him.
yes, go ahead and sue the people that tried to help him.
that way, when other people go to get help from the doctor, they can't afford it because the premiums are too high because people like you SUE them and they have to pay medical malpractice insurance.
just let it go. it was his time. nobody's fault.
there's not always someone to blame. it's just LIFE.

Sounds like gross negligence to me. And not just "oh my god, they botched the surgery" (sometimes you can't save the patient), the surgery went fine and they actually had the ability to prevent this. Poor post-operative procedure.

I'm not a litigious person, nor do I support petty lawsuits, but your case sounds legitimate in my opinion.

this is why people don't want to become doctors. everyone thinks that they're miracle workers and automatically blame you if something goes wrong. its called life. get over it.

you should pray about it... not joking about that either. prayer is one of the main things that will help you find an answer.. personally, I would not sue. people sue over the dumbest things... but the doctors at that hospital are people too and all people make ,mistakes., you chould write a letter to the boss of that doctor, and write your feelings in that letter. ... I personally do not think sueing will do anygood.

Sorry for your loss, no you shouldn't sue because you will regret it, you need to spend your time remembering your father for the great man he probably was. You wanting to sue the hospital is probably a sign of grief

no...i don't feel like suing would help anything at all. They obviously put him in there because they felt like he would be able to handle it. they can't keep everyone in PCU all the time. nobody can predict everything that is going to happen with a patient...it was an unfortunate occurrence that nobody could have helped

No amount of money will bring your dad back.

If you're considering suing though, contact a lawyer and ask their professional opinion.

you could try, but if your father had survived, how would the quality of his life and your family's been affected? in my opinion, your father seems to have had alot of problems w/ his heart and the inevitable would have happened anyway...my condolences...

You have a right to sue however after the stress test you said he was doing "better" therefore not needing 24 hour monitor and not requiring PCU

I believe if he had not passed away and they were successful in the second stint he would have passed away regardless, it was just his time to go. Sorry for your loss

Things happen, can't blame doctors... they did all they could... a monitor might not have saved his life...he had a bad heart

You have to have proof, like not just your word for it but testimony from doctors and nurses and that isn't likely if they work for them. I can't see how they could take someone out of PCU and put them in a room with no heart monitor. That makes no sense at all. You might have a case but like I said its their word against yours...

Let me start off by saying that I am very, very sorry for your loss. I don't mean to doubt your story - but I have a hard time believing that a hospital, monitoring a patient who has just undergone heart surgery before subjecting him to another cardiac procedure - would not have the patient on a heart monitor. He didn't have any wires connected to him - maybe a pulse oximeter? Have you spoken with his cardiologist directly? The information you have - did that come to you directly from the hospital staff, or was it filtered through family and friends? The cardiologist would (or should) surely take some time to sit down and thoroughly explain what happened. If and when that happens, and if you still have concerns, maybe contact an attorney for advice. I would just hate for you to go through the pain of a lawsuit with this type of emotional weight unnecessarily. Best wishes, and again, I'm sorry for your loss.

As long as you have evidence showing those percentages and that you can show negligence in their decisions. Have you sought a second opinion to see what another heart physician would have done? And one that would testify for you? You can definitely sue them for that! Good luck and hope you win! They made a poor decision! I am sorry for your loss!!

Are you money hungry??? For one, how do YOU know there was no heart monitor? Just because there was not one in the room, does not mean there are not monitors at the nurse's station.

How late was "too late?" Could not have been that long if they were able to revive him! How do you know he had "too much brain damage?"

Plus, YOU indicated his heart was too weak and gave out!!!

To me, they were not negligant. Now, if they would have put the other stint in (93%) and did not do a stress test, that MAY have been negligant.

It appears they did the best they could have done for him.

What is considered "poor care for patients?"
