No. The reason it is illegal is because it is wrong. It is reprehensible. It is disgusting. It is gross. Only a morally bankrupt person would commit incest. What planet are you from? Check yourself into a mental institution if you are into incest. |

You have posed a very interesting question. I personally do not believe incest should ever be legal. But, I'm also not a fan of government imposed morality.
I have never heard of any countries "legalizing" incest. There are countries that have no laws regarding the subject. Lack of a law is not the same as legalization. |

Incest legal prosecution has two reasons:
1) to protect family
2) to ensure an healthy offspring
Number 2 is not enough to justify criminal prosecution
I. offspring isn't at risk in some cases of incest (legal definition of incest relations varies according the State or Country): eg for relation between adoptive relatives or in-laws
II. one partner can be infertile
III. if this was the only rational behind incest, prosecution had to start only in event of an actual fertilization
So actually incest is prosecuted mainly for the reason 1), it is for a moral and deep-rooted taboo (an almost universal taboo).
Incestous relation are a very very little minority:
- Even without a legal prosecution, their number wouldn't grow up
- even WITH legal prosecution, their number don't go down
So why punish them?
I'm speaking about a relation between consenting adult with mental capacity.
Who is harmed in the process?
I and most persons would shudder at the only think to commit incest. But this can't be a legal issue.
Anyway, if a person thinks incest has to be prosecuted, it's him who has to argue why |
