Do you mean 'THE' flag or 'A' flag? If you want to specify 'THE' flag then you need to say which flag since this questions pops up around the world on sites belonging to other countries. Let's assume you mean burning the flag of the nation in which the burning takes place.
Much as my views are liberal on many things, I believe that respect for nationhood and all it represents is fundamental to the continuing existence of a civilised society. To allow disrespect of so fundamental a symbol of nationhood as the flag of the county in which you live is a threat to the integrity of that society so I believe it should be illegal. If you have a grievance with any aparatus of the nation, there are mechanisms for raising those concerns and, ultimately, the ballot box.
On the other hand, the burning of the flags of other nations in which you have no right of representation and in which you are not resident should not be illegal unless the act of starting the fire is independently illegal. |

When the members of the American Legion burn old, soiled and torn flags (like the ones idiots fly from their cars), I don't think they should be prosecuted for that as that is the recommended way of disposing of old, soiled and torn flags. Any effort to distinguish that from those who are doing so in a manner that you consider disrespectful is necessarily going to be a limitation on expression, based on the content of that expression, and I find that proposal abhorrent and contrary to the basic nature of a free society.
I noticed that Russia has a new law that allows those who criticize the government to be prosecuted as traitors. I disapprove of such laws in the u.s. |

The Supreme Court has stated numerous times that this is legal. The reasoning is that burning the flag in protest against the government is a form of symbolic speech and is therefore protected by the 1st Amendment. |

It's only illegal if it's burned in effigy. If it touches the ground, it must be burned or buried to show it the proper respect. Kind of the same way a person is buried or cremated upon their death. |

Legal. One of the great things that flag is SUPPOSED to represent is the right to protest and/or air extremely unpopular views.

not that flag burning is unpopular mind you - probably every veteran's organization has flag burning ceremonies at least once a year. It is the proper way to get rid of a flag that is no longer fit for use. google it if you don't believe me. |

I recall years ago when this was a big issue. I beieve in free speech, and if a fool wants to demostrate exactly why he wants others to hate him, he has the right to be hated. I'm not sure if it was true or not, but I heard that the state of Louisiana came up with the perfect legal response to flag burning. It's legal to do it, and it's a $5 fine to beat up the flag burner... |
