Should i sue my former boss? i was only trying to do my job!!!?

i was waitressing at Denny's. my boss told me to be polite and try to suggestive sell. a obese young lady sat at my table...(she couldn't squeeze in a booth!!) any hoo...she ordered a cheeseburger and fries. i (very politely) asked her if she'd like a salad intead. she asked why. i told her i thought a salad would be healthier for her and with her weight problem it would be a wiser choice. she had a fit and talked to my boss. he took me in the back room and told me that this was my third customer complaint in a week and he'd have to let me go! i was trying to do lard-butt a favor...how many other people point out her weight problem to her??? Denny's was lucky to have me!! should i sue???

You are OBVIOUSLY too intelligent and over qualified for Denny's. Your manager just felt threatened. Sue him but have pity on him.

OMG, how freaking rude...of him. So let me get this straight. As a waitress, you offered her a delicious option of a healthy, cheAP and tasty meal and she got all pissy and had u fired. I would definately sue. If you were to sell Denny's food, and we all know salads are priceier than some lame cheeseburger and fries. She should've gone to Burger King and enjoyed a whopper if a burger is what she wanted. I applaud u for trying to give her a healthier option. I feel bad that you lost your $1.19 /hour waitressing job. I would definately sue AND sign up for unemployment.

First of all, I want to say that I don't think you did anything wrong. I would not have fired you for that. In fact, you should be commended for your moral values. But please allow me to play the Devil's advocate. What you did was you passed on a potential HUGE sale. Not only did you miss on a burger and fries sale, there was a good chance you would have sold a dessert or two. On top of that, an aggressive server could have sold a Grand Slam breakfast to go. Ya gotta sell the people what they want, not what they need.

you're an idiot. ever thought of the fact that you're probably not the first person to hint the woman that she's fat. That was mean of you to tell her to have salad instead. It's non of your business what she eats. If she wants a burger you give her a burger politely no questions and no comments added. You don't hint her "hey it would be better for you to have something healthy because you can't even fit in the booth" that's what you pretty much said. Well that's how she heard it. You can't sue the boss for firing you if there were customer complaints against you.

Lol, I understand you were concerned but If I was fat, and if I heard that from a waitress, I'd be really pissed too, its just that, she didnt come to the restaurant to feel guilty, you're probably pretty, and if she heard it from you, she would have a 100 emotions going through her mind, on, why did you say it? and honestly, being in the hotel business myself, you really cant do that to any customer.

When your manager said be polite, you asked her if she wanted a salad, but you didnt have to give her a reason to her face, you could have been like, we have excellent salads here, you would really enjoy it, or something like that.

Anyway, I dont think you can sue...

Please sue, so you can be categorized into the same group as those who sue Mcdonald's for getting burned by hot coffee....You were only doing your job if you are a personal trainer...are you? no, you waited tables, you served food. In order for you to keep that job, you need fat people who like to eat lots to keep you in business :)

I think what your boss meant was to actually sell waht the customers want, not what you think they should have....

I must admit, we say we want people to be honest to us, but in business-wise, that's not a very good factor.

Next time, just give the customer what he wants.

Of course in our society that is not a good thing to do...But if that woman wants to stuff her fat *** with fatty foods then let her...You did what I wish I could to some people. Its just disgusting when people do that to themselves. If they have a health problem that CAUSES them to be obese then thats fine...which is most obese people's excuse, however, it is the weight is the cause in this case, not the effect. Being monstrously overweight is not what the normal human species is supposed to be like...so of course it will cause health problems. It's just the same as doing anything else that's abnormal to your body...smoking, drugs, ect...

Also, I don't think you would win if you sued...Denny's is a restaurant for fat blobs like her to expand their body mass, so telling her to order a salad would be objecting to her purpose, I mean come on, she drove all the way to dennys so she could get fatter, and you tried to stop her! How could you do such a thing? lol...just find a new job and keep your comments to yourself...That woman will pay for it soon.

well at least you didnt offer her some anti-freeze, i did that so a guy i never met before or again at a party who asked me for some drugs.. I said DUDE do I even LOOK like I do drugs, I'll tell you what I do have is some antifreeze in a jug in the trunk of my car, and you're welcome to go drink it so you won't ask total strangers stupid questions like this anymore.

If anything, your lucky the costumer did not sue you or the restaurant. In fact I am very surprised she didn’t. You have to think about what you say before you say it. If I was your waitress, and I came up to you and suggested, politely, that you should try the shut the **** up meal with a side of keep your nasty opinions to yourself, because it would be a healthier choice, so you don’t end up with a foot in your ***, would you agree and order it?

Ummm...no because see, though you thought you were doing that lady a favor, you were still wrong because she can actually sue Denny's for discrimination because it's almost like you refused to serve her what she wanted because she was fat. It's almost like...okay, I'm black and I walk in and want fried chicken and you "suggest" that I shouldn't get that because it's a stereotype for black people to like fried chicken and make me order a steak instead...it's unfair. I think what your boss meant was to suggest popular items on the menu if the costumer is unsure of what they wanted in the first place. I say you should just take it with a grain of salt and find another job where you can possibly be a little more...honest without making peole upset. Good luck!

If you can find a lawyer who'd take your case, feel free to waste your money on it. You have no grounds. You deserved to be fired. You aren't in a nutritionist/dietician, obviously, if you are waitressing, and therefore are in no position to tell a stranger what they should or should not eat.

I think that you were being horrible to that woman! you deserved to be fired. I'm not so overweight it's like visible, but whenever anyone calls me fat, I feel like crying for hours. You are just a slave to the media and follow dumb stereotypes. I think your boss had every right to give you the pink slip, and you can try to sue him/her...but you won't have a case. oh, btw, it's people like you who are the cause of serious disorders that may be fatal to young girls.
